THE CITY OF Planning Commission
—.. m : m app
1 Agenda Report
LE AR February 23 2022
Item 4
SUBJECT: P21-1206
APPLICANT: Robert A. Rossi for Sunshine Saloon
PROPERTY OWNER: Pleasanton Valley Plaza, LLC
PURPOSE: Application to modify an existing Conditional Use Permit (UP-91-
77) to allow outdoor consumption of alcohol at an existing bar.
LOCATION: 1807 Santa Rita Road, Suite K
GENERAL PLAN: Retail, Highway, and Service Commercial; Business and
Professional Offices
ZONING: PUD-C (Planned Unit Development — Commercial) District
EXHIBITS: A. Draft Resolution
B. Project narrative dated received "December 22, 2021"
C. Planning Commission Resolution No. PC-91-96 for
UP-91-77 dated November 20, 1991
D. Planning Commission Meeting Minutes dated November 20,
1991
E. Location and Notification Map
STAFF RECOMMENDATION
Approve Conditional Use Permit (CUP) Case No. P21-1206 modifying the conditions of
approval for UP-91-77 based on the findings and conditions of approval in Exhibit A.
EXECUTIVE SUMMARY
The proposal would remove existing CUP (UP-91-77) Condition of Approval No. 6, prohibiting
the consumption of alcohol outside of an existing bar (Sunshine Saloon) at the subject
location. Due to the current pandemic, on June 19, 2020, Sunshine Saloon received approval
for temporary outdoor dining, including outdoor alcohol service, at this location. This temporary
outdoor dining approval has operated since that time without any reported incidents or
complaints. Sunshine Saloon seeks to remove Condition of Approval No. 6 from their existing
CUP to facilitate permanent outdoor dining, with alcohol service, at the subject location. The
existing CUP for Sunshine Saloon includes conditions of approval which would continue to
ensure the safety and general welfare of the surrounding area, and the City in general, is
maintained. Similarly, additional conditions of approval have been included with staff's
recommendation on this proposal ensuring the existing bar's continued conformance with
these standards. This proposal is now before the Planning Commission for consideration.
n discussed the proposed lift and questioned
whether the project was better without the lift or with the lift that would get used when needed.
Commissioner Brown stated the tenant might use the lift if they had two cars or to store a car
used infrequently. He discussed options for the Commission's recommendations on the
project.
Chair Pace asked if any Commissioners had concerns about the design. The Commissioners
indicated support for the design and clarified that the only concerns were related to parking.
Commissioner Allen moved to deny the project as proposed.
Ms. Clark stated the applicant could appeal the decision to the City Council.
Commissioner Brown moved to approve the project removing the lift and lift screening
but approve the in-lieu parking fee. The motion died due to lack of a second.
Commissioner Gaidos seconded Commissioner Allen's motion to deny the project.
Planning Commission Minutes Page 7 of 9 January 12, 2022
asked why the project was
proposing the lift. Ms. Clark explained that the lift spot was better than no space.
THE PUBLIC HEARING WAS OPENED
Planning Commission Minutes Page 5 of 9 January 12, 2022
