DISCUSSION <br />In order for the ORRO to apply in Pleasanton, the City must adopt an ordinance <br />incorporating the ORRO by reference. The ORRO is primarily based on a model <br />developed by CalRecycle. Its purpose is to incorporate SB 1383 requirements and <br />serve as the enforcement mechanism that the law requires. <br />The ORRO requirements include the following: <br />• Single family, multifamily and businesses must have organic waste and recycling <br />collection service and sort properly <br />• Businesses and multifamily buildings must educate employees and tenants about <br />proper sorting and must provide labeled bins. In addition, businesses must <br />monitor for contamination <br />• City or its designee must assist with SB 1383 implementation in several ways, <br />such as conducting or complying with route reviews (i.e., contamination <br />monitoring) and providing compliance data to enforcement agencies <br />• Commercial edible food generators (e.g., grocery stores, restaurants, wholesale <br />food distributors, and others) must recover surplus edible food, have a contract in <br />place with a food recovery organization or service, and keep monthly records <br />• Food recovery organizations must keep records and report the amount of food <br />collected. <br />There are two policy considerations for the City Council: <br />1) Whether or not to opt -into the ORRO and make conforming changes to the <br />municipal code; and <br />2) If the City Council determines to opt -into the ORRO, shall the City delegate <br />authority to WMA, the Alameda County Department of Environmental Health <br />(ACDEH), and other entities as necessary as it relates to Commercial and Multi - <br />Family Generators, Haulers, Self -haulers, Food Recovery Organizations and <br />Services, and Edible Food Generators in the areas of outreach and education, <br />compliance monitoring and enforcement. <br />City staff recommends that the Council adopt by reference WMA's ORRO and approve <br />the conforming amendments to the municipal code to comply with SB 1383. In addition <br />staff recommends delegating authority to WMA and the Alameda County Department of <br />Environmental Health (ACDEH) in the areas of outreach and education, compliance <br />monitoring and enforcement as it relates to Commercial and Multi -Family Generators, <br />Haulers, Self -haulers, Food Recovery Organizations and Services, and Edible Food <br />Generators. Finally, City staff recommends delegating authority to appoint a Designee <br />of the City in the areas of the areas of outreach and education, compliance monitoring <br />and enforcement. By adopting WMA's ORRO and delegating authority to WMA, <br />ACDEH, and other entities as necessary, the City will be able to maximize efficiencies <br />and reduce the cost of implementation. Currently, WMA and ACDEH will not be <br />charging the City for the enforcement duties delegated to them. <br />Page 4 of 8 <br />
