• If a jurisdiction allows self -hauling, such jurisdiction shall adopt an ordinance that <br />requires self -haulers to comply with SB 1383 requirements. <br />• Adopt an edible food recovery ordinance or similarly enforceable mechanism requiring <br />Tier One Commercial Edible Food Generators to comply with the following by January <br />1, 2022, and Tier Two Commercial Edible Food Generators to comply with the following <br />by January 1, 2024: <br />o Arrange to recover the maximum amount of edible food for human <br />consumption that would otherwise be disposed by contracting with a food <br />recovery organization or service, or by self -hauling edible food to a food recovery <br />organization. <br />o Prohibit a commercial edible food generator from recovering no edible food <br />unless there is insufficient recovery capacity or qualifying extenuating <br />circumstance. <br />o Prohibit a commercial edible food generator from intentionally spoiling edible <br />food that could be recovered for human consumption. <br />• Adopt an edible food recovery ordinance or similarly enforceable mechanism requiring <br />edible food recovery services and organizations that collect or receive edible food <br />directly from commercial edible food generators to maintain records of the contact <br />information for each commercial edible food generator that collects and receives food <br />from, the quantity in pounds of edible food collected or received and transported per <br />month, and the contact information for each food recovery service. <br />• Adopt an ordinance to regulate haulers collecting organic waste. A jurisdiction's <br />ordinance/mechanism shall require hauler compliance with SB 1383 regulations, <br />including: compliance with collection program requirements and identification of facilities <br />where they will transport organic waste. <br />• Adopt enforceable ordinance(s), or similarly enforceable mechanisms requiring <br />compliance with provisions of the California Green Building Standards Code <br />(CALGreen) related to construction of buildings with adequate space for recycling <br />containers and 65 percent Construction and Demolition Debris recycling. <br />Based on the input from jurisdictions, WMA developed a countywide ordinance — called <br />the Organics Reduction and Recycling Ordinance (ORRO) — to serve as the <br />enforcement mechanism. The ORRO includes requirements from the existing <br />Mandatory Recycling Ordinance (MRO) that were not included in the CalRecycle model <br />ordinance. The ORRO would supersede the MRO. Currently, all other cities in Alameda <br />County have either opted -in or plan to opt -in to the ORRO to meet the regulatory <br />ordinance requirement. <br />On October 8, 2021 The City Council Subcommittee on Waste and Recycling <br />(Brown/Testa) met to review proposed ordinance and recommended that the item be <br />brought forward to the City Council for consideration. <br />Page 3 of 8 <br />
