B. Notice of the director of community development's decisions shall be provided to <br /> the planning commission. Such decision is subject to appeal in accordance with <br /> the provisions of Chapter 18.144. <br /> Similar provisions are included in DSP Policies LD-P.18 and LD-P.19 noted in the previous <br /> section. The intent of DSP Policy LD-P.18 and PMC 18.81.020 is to provide some flexibility to <br /> accommodate a non-active use in conjunction with an active use, with the 25-percent <br /> requirement specified to ensure a.) the active component will be the more prominent <br /> "storefront" use, when viewed from Main Street and b.) it constitutes more than a token amount <br /> of active use within the overall space. <br /> With respect to DSP Policy LD-P.18 and PMC Section 18.81.020, based on the updated <br /> information provided by the applicant, a dedicated retail component would be incorporated into <br /> the tenant space. The first 21 feet, 6 inches (32-percent of the depth of tenant space) would be <br /> dedicated for retail display and merchandise (see Figure 3 above). The applicant proposes to <br /> sell skincare products, vitamins, tea, water bottles, and water ionizer and filtration systems and <br /> has obtained a seller's permit with the State of California for this component of the business. A <br /> cash register with point-of-sale system is proposed and the hours of operation are 11:30a.m. to <br /> 6p.m. Tuesday through Friday, 12-5p.m. on Saturday, with the business closed on Sunday and <br /> Monday, which is consistent with many retail businesses in downtown. The configuration of the tenant space is such that it would have a storefront <br /> frontage of less than 10 feet (as determined by the director of community <br /> development) on a designated active street. <br /> 3. Staff believes the original proposal for a ground floor <br /> personal services use with ancillary retail sales (as submitted in May) is not consistent with the <br /> DSP policies and does not promote an active pedestrian environment similar to retail, <br /> restaurants or other establishments in the downtown. The <br /> front building is a multi-tenant, one- and two-story structure with the two-story portion adjacent <br /> to Main Street, stepping down to one-story behind. The other building on the subject site is a <br /> one-story, single-tenant building. A private parking lot is located at the rear of the property and <br /> has seven parking spaces. The appellant's tenant space is located on the ground floor of the <br /> front building and the tenant space is approximately 1,065 square feet.
