The construction of the public improvements necessary for the JDEDZ requires that the <br /> City acquire property rights over a portion of two properties located along Johnson Drive <br /> to the north of Stoneridge Drive and east of the 680 freeway (T.P. Heritage Inn of <br /> Pleasanton, LLC S.S. Heritage Inn of Pleasanton, LLC, APNs 941-1300-14 and 941- <br /> 1300-15 and Pacific Telephone and Telegraph Company, APNs 941-1300-17 and 941- <br /> 1300-18). The Properties are further identified in the Exhibits attached to the proposed <br /> Resolutions of Necessity. The City has been unable to reach agreement with the <br /> property owners for the acquisition of the Properties. <br /> In order to adopt a Resolution of Necessity, the City Council must find and determine <br /> that: <br /> A. The public interest and necessity require the Project; <br /> B. The Project is planned or located in the manner that will be most compatible with <br /> the greatest public good and the least private injury; <br /> C. The Properties are necessary for the proposed Project; and <br /> D. The offer required by Section 7267.2 of the Government Code has been made to <br /> the owners of record. <br /> The public hearing on the Resolutions of Necessity relates only to the findings <br /> described.above. Any other issues, including value, are not proper subjects for the <br /> public hearing. <br /> DISCUSSION <br /> A. The Public Interest and Necessity Require the Project. <br /> Johnson Drive is a designated arterial roadway in the General Plan and is generally a <br /> two-lane facility with a dual left turn lane in the center for approximately 1,000 feet north <br /> of Stoneridge Drive. Through most of the area studied for the proposed JDEDZ, a single <br /> vehicular travel lane and bicycle lane is provided in each direction. Direct driveway <br /> access is provided from parcels to and from Johnson Drive. On-street parking is <br /> permitted in proximity to Commerce Drive on the west side of the roadway. Johnson <br /> Drive has a posted speed limit of 40 mph through the EDZ area. Field observations <br /> indicate that the on-street parking is well utilized for most of the day. There are no <br /> sidewalks along Johnson Drive with the exception of a short (approximately 1,200-foot) <br /> area of sidewalk extendingnorth from Stoneridge Drive, alongthe south and west side <br /> 9 <br /> of the street. <br /> In connection with the JDEDZ, the proposed real property acquisitions will allow the City <br /> to widen and improve Johnson Drive. The JDEDZ will generate increased traffic, <br /> affecting the levels of service and vehicle queue length spillback in and around the <br /> project area. Improvements to Johnson Drive are necessary to maintain acceptable <br /> levels of service, acceptable vehicle queue spillback and acceptable freeway ramp <br /> operations. The improvements include the widening of Johnson Drive from a two lane <br /> roadway to a four lane roadway with buffered bike lanes and pedestrian walkway.
