HERITAGE INN OF <br /> PLEASANTON, LLC AND S.S. HERITAGE INN OF PLEASANTON, <br /> LLC, APNS 941-1300-14 AND 941-1300-15, AND PACIFIC <br /> TELEPHONE AND TELEGRAPH COMPANY, APNS 941-1300-17 AND <br /> 941-1300-18) <br /> SUMMARY <br /> The construction of the public improvements necessary for the Johnson Drive Economic <br /> Development Zone ("JDEDZ" or "Project") requires that the City acquire property rights <br /> over a portion of two properties in the JDEDZ ("Properties"). The City has been unable <br /> to reach agreement with the property owners for the acquisition of the property rights. <br /> Therefore, staff is recommending that the City Council consider the filing of eminent <br /> domain actions, which will allow the City to proceed with the Project while fair market <br /> value is determined by the Court. Before eminent domain cases can be filed, the City <br /> Council must adopt, by at least a 4/5 vote, Resolutions of Necessity. - <br /> RECOMMENDATION <br /> Adopt the proposed Resolutions of Necessity. <br /> FINANCIAL STATEMENT <br /> The value of the Properties will be established through the eminent domain process. <br /> The costs of acquisition of the Properties are addressed in the JDEDZ Transportation <br /> Improvement and Cost Allocation Agreement. <br /> BACKGROUND <br /> The JDEDZ is a proposal to spur investment in 40-acres of mostly under-utilized or <br /> vacant land situated along Johnson Drive near 1-680 and Stoneridge Drive. The goal of <br /> the JDEDZ is to: transform the area into a thriving commercial corridor that capitalizes <br /> on its location at the intersection of the 1-580 and 1-680 freeways; create opportunities <br /> for new uses and services in the community; and generate new tax revenue to support <br /> City services and programs. City Council approved the JDEDZ on February 4, 2020 <br /> (Resolution No.20-1132 and Ordinance No. 2207). <br />
