ATTACHMENT 4 <br />PUD -114-01 M/P20-0995/P20-0994. Guv Houston. on behalf of Resurrection Greek <br />Orthodox Church for Pleasant View Church of Christ. 11300 Dublin Canvon Road <br />Applications for: (1) a Major Modification to Planned Unit Development (PUD -114), (2) Minor <br />Subdivision, and (3) Conditional Use Permit to construct and operate a 9,792 -square -foot <br />church and 24,971 -square -foot multi-purpose building with gymnasium on a 4.3 -acre portion of <br />the 16 -acre Pleasant View Church of Christ site located at 11300 Dublin Canyon Road. Zoning <br />is PUD-RDR/A-OS (Planned Unit Development — Rural Density Residential/Agriculture and <br />Open Space) District. 381,000 square feet, a parking structure, and related site improvements <br />over multiple phases; as well as (3) make a finding of General Plan conformity for a related <br />Development Agreement to vest the entitlements for the PUD Rezoning and Development <br />Plan. <br />Associate Planner Jennifer Hagen presented the specifics of the item in the Agenda Report. <br />Commissioner Allen thanked the applicant and project team for making changes as previously <br />recommended by the Commission. She asked if the conditions regarding specified uses <br />excluded daycare. Ms. Hagen stated all events over 350 attendees required a temporary use <br />permit, and that the narrative excluded a daycare, meaning an amendment to the CUP would <br />be necessary to allow it. Commissioner Allen requested a condition outlining the specifics of <br />the narrative. Ms. Hagen referenced Exhibit B outlining the narrative and conditions. <br />Commissioner Allen expressed concern with the narrative getting lost as part of the project <br />record. Ms. Clark confirmed the project approvals were retained in the permanent electronic <br />records including the attached narrative. Commissioner Allen asked about restrictions on use <br />of the commercial kitchen, in addition to screening and lighting on the east side, as concerns <br />were expressed about screening and lighting in the public comments received from Don and <br />Sandee Otto. <br />Ms. Hagen displayed a visual and highlighted the property line, showing the dense tree <br />covering that encompassed the creek corridor and distance from the anticipated parking lot. <br />She stated the concern about the possibility of lights from vehicles shining into the Otto's <br />property and indicated the Otto's had requested additional screening. Commissioner Allen <br />inquired about heritage trees being removed, especially on Dublin Canyon Road and the <br />mitigation value to be paid by the developer. Ms. Hagen stated the arborist report showed the <br />dollar value for the trees and referenced the condition requiring the developer to pay the value <br />of the trees. <br />Commissioner Gaidos questioned the proposed tree plantings. Ms. Hagen confirmed the <br />plans to plant along the western edge. Commissioner Gaidos thanked the applicant for the <br />revisions made, including the meandering sidewalk. <br />Commissioner Nibert asked about use of the kitchen for church events. He inquired if Open <br />Heart Kitchen (or similar community groups) would be allowed to use the kitchen. Ms. Clark <br />stated that the church might elect to enter into an agreement for such use; staff would evaluate <br />whether it was allowable based on the scale and nature of the use. <br />Commissioner Pace inquired how use by charitable services would be determined. Ms. Hagen <br />stated open communication between the church and the City would be utilized to determine <br />use and overall impacts. She discussed commercial kitchens in other churches in the City. <br />She discussed use for charitable events or non-profit businesses.
