ARTICLE 3 <br /> <br />MAINTENANCE OF TRAFFIC SIGNALS <br /> <br />AND BUS SHELTERS <br /> <br /> 3.1 Traffic Signals. <br /> <br /> The City shall maintain, or contract to have <br />maintained, all traffic signals within Hacienda Business <br />Park, all traffic signals on Hopyard Road between Owens <br />Drive and Valley Avenue, inclusive, and the traffic signal <br />at the intersection of West Las Positas Boulevard and Santa <br />Rita Road (collectively, the "Traffic Signals"). <br />Maintenance shall mean the care of the Traffic Signals, <br />including repair and replacement where necessary. If the <br />City elects to contract for such maintenance, the City shall <br />exercise due diligence to minimize the cost of the contract. <br />The Association shall reimburse the City for the actual cost <br />of maintenance of the Traffic Signals. The Association <br />shall be directly billed for and shall pay all electricity <br />charges resulting from the operation of the Traffic Signals. <br /> <br />Reimbursement to the city for maintenance costs shall be <br />made within 'thirty (30) days after receipt by the <br />Association of a statement from the City for the <br /> <br />Association's share of such charges accompanied by copies of <br />invoices from the contractors performing such maintenance, <br />which invoices demonstrate that said contractors have been <br />paid by the City. <br /> <br />-10- <br /> <br /> <br />
