BACKGROUND <br /> The omnibus ordinance is an annual practice where multiple minor changes are <br /> proposed to the Pleasanton Municipal Code. These changes often reflect updates in <br /> California law, changes to the code to reflect current city practices, deleting out-of-date <br /> provisions and references, and correcting typographical errors. These non-controversial <br /> code updates are combined into a single omnibus ordinance. <br /> During this omnibus review, an amendment is also proposed for the Master Fee <br /> Schedule to correct a reference to the business license tax as provided in Pleasanton <br /> Municipal Code Chapter 5.12. <br /> DISCUSSION <br /> Each of the proposed amendments to the municipal code are described below and <br /> shown in Attachment 1.1 <br /> §6.40.070 Taxi business license tax. Correction to properly reference business license <br /> tax, not fee, in Chapter 5.12. <br /> §14.04.130 Water service disconnection per state law. State law (SB 998 in 2018) <br /> mandates that water suppliers, such as the City, provide minimum time periods before <br /> water service can be discontinued due to non-payment. §14.04.130 is proposed to be <br /> amended to match this state requirement for a water bill to be unpaid for sixty (60) days <br /> before potential disconnection. <br /> §§17.08.150 and 17.08.180 Update construction standards to maintain flood protection <br /> rating. The state allows local governments to adopt regulations to prevent flood <br /> damage, as the City has done in Municipal Code Ch. 17.08 Flood Damage Prevention. <br /> An update is proposed to meet evolving federal standards by raising the floor elevation <br /> for new and substantially improved construction in the Special Flood Hazard Area <br /> (SFHA) to one foot higher than the base flood elevation. This change reduces flood <br /> damage to properties in the SFHA. The City participants in the Federal Emergency <br /> Management Agency (FEMA) Community Rating System (CRS) program where <br /> communities achieve higher CRS class ratings by implementing specific building <br /> requirements for properties within the SFHA. This amendment allows the City to <br /> maintain its CRS Class 7 rating for a 15% insurance discount for property owners. <br /> §17.16.020 Replacement trees. When property owners seek permission to remove a <br /> heritage tree (generally trees with a trunk of 55+ inch circumference or 35+ feet tall), <br /> they are asked to replant a tree that has the potential to become a heritage tree in the <br /> future. The proposed amendment would formalize the requirement for replacement tree <br /> planting, and irrigation for establishment. <br /> Title 18 Zoning. Many sections are proposed for amendment to clarify existing City <br /> practice, fix internal references and correct typographical errors, as follows: <br /> The ordinance shows proposed amendments in track changes. If introduced by the council on <br /> June 1. at the subsequent meeting where the ordinance is adopted / second reading. the <br /> amendments will be shown in final form as required by the code compilation company. <br /> Page 2 of 4 <br />
