9'0298 f n <br />Nine (459) days after the commencement of <br />Phase Two, shall again become subject to a <br />restriction against their exercise as of Four <br />Hundred Fifty-Nine (459) days after the <br />commencement of Phase Two. Such number of <br />unused Sewer Permits shall be referred to as <br />"Phase Two Restricted Permits". This <br />restriction shall be lifted and the final <br />Thirty (30) days shall commence to run on the <br />later of (A) a date Ninety (90) days after <br />completion of the Stoneridge Drive <br />Interchange, or (B) One Hundred and Eighty <br />(180) days following the earlier of the <br />expiration or use of the Phase Two Permits <br />other than the Phase Two Restricted Permits. <br />(2) Government Action or Litigation. In the <br />event of any governmental action or litigation that <br />prevents Owner from obtaining a building permit (where <br />Owner is otherwise prepared to submit the necessary <br />information and pay the fees required in order to <br />obtain a building permit) the dates provided in <br />subparagraph (1) of this Paragraph 4A shall be delayed <br />by the actual amount of delay caused by such <br />governmental action or litigation, but only with <br />13 <br />
