<br />8y-0~';;~ i (1 <br />respect to the Sewer Permits rendered unusable by such <br />governmental action or litigation. <br />B. The parties agree that the effect of this <br />Paragraph 4A is to suspend the running of the remaining <br />portion of the three year period with respect to each <br />Property Sewer Permit by the period during which Owner is <br />prevented by this Amended Development Deferment Agreement <br />from using that Property Sewer Permit to obtain a building <br />permit. <br />5. Additional Sewer Restrictions. In consideration <br />for the execution of this Amended Agreement by City, the <br />other parties to this Amended Agreement agree to the <br />restrictions imposed by this Paragraph for so long as there <br />remain valid Property Sewer Permits which have not been <br />allocated to improvements which are the subject of building <br />permits (whether or not such buildings have been <br />constructed). Owner or any successor in interest to a <br />portion of the Property which has been subdivided or <br />otherwise legally divided from the balance of the Property, <br />shall not be entitled to obtain additional sewer capacity <br />from the City pursuant to its "first come, first served" <br />policy with respect to any additional sewer capacity <br />required by Owner or successor until all 188 Property Sewer <br />Permits have either expired or been allocated to <br />14 <br />
