BACKGROUND <br /> On January 19, 2021, the City Council voted 4-1 to introduce the Ordinance, including <br /> modifications to address two-story ADUs. <br /> On February 16, 2021, the City Council voted, 3-2, to introduce the ordinance as <br /> modified, reflecting the direction provided on January 19, and with several additional <br /> modifications and clarifications. Staff has incorporated further changes to the ordinance <br /> to reflect this latter direction, included as Attachment 1. <br /> DISCUSSION <br /> As noted in the Summary, on February 16 the City Council directed staff to make <br /> additional modifications to the municipal code. The following summarizes the changes <br /> directed by City Council and provides a reference to the section of the municipal code. <br /> A. Prohibit ADUs above 16-feet in height, attached or detached, except when the <br /> ADU is the result of the conversion of existing space. PMC §18.84.150(E) was <br /> struck and PMC §§18.106.040(A) and 18.106.045(A) were modified. <br /> (Note: these revisions to the PMC reflect direction from the City Council on <br /> January 19 and were provided to the Council for review as part of the February <br /> 16 meeting materials1.) <br /> B. Add language to allow consideration of ADUs greater than 16 feet in height in <br /> new Planned Unit Developments. PMC §18.106.040(A) and PMC <br /> §18.106.045(A) were modified. <br /> C. Require a 10-foot street side setback for detached ADUs that exceed 800 square <br /> feet in size. PMC §18.106.045(B) was modified. <br /> D. Require landscape screening and solid fencing along rear and interior side <br /> property lines adjacent to an ADU, but for corner lots allow the owner to provide <br /> either fencing or landscaping along the street side property line. The solid <br /> fencing requirement would not apply to PUDs where open fencing is required. <br /> PMC §18.106.060(C)(1)(b) was modified. <br /> E. Retain the owner-occupancy requirements for ADUs approved prior to January 1, <br /> 2020. <br /> • PMC §18.106.060(A): Existing text that required owner-occupancy that <br /> was previously proposed for strikeout, is now proposed to remain. A <br /> sentence was added indicating owner occupancy for the primary dwelling <br /> or the ADU is not required for ADUs approved between January 2020 and <br /> January 2025, as mandated by state law. <br /> • PMC §18.106.060(l): Existing text that required a deed restriction for <br /> ADUs that was previously proposed for strikeout is proposed to remain. <br /> ' The revisions include clarifications to ensure consistency with State law, reflecting a limitation on total <br /> height, rather than a strict limitation on number of stories. <br /> Page 2 of 4 <br />
