Although the absence of a deed restriction does not exempt a property <br /> owner from the owner-occupancy requirement, the deed restriction <br /> reinforces the requirement for owner occupancy and thus the language <br /> requiring a deed restriction is now proposed to remain. <br /> • PMC §18.106.070(L): Similarly, existing text that required a deed <br /> restriction for JADUs that was previously proposed for strikeout is <br /> proposed to remain. <br /> F. Limit the maximum size of a new ADU consistent with State law (850 square feet <br /> for a studio or 1-bedroom unit and 1,000 square feet for a two or more-bedroom <br /> unit), except when the ADU is the result of the conversion of existing space in <br /> which case the ADU may exceed these size limits. PMC §18.106.040(B) and <br /> PMC §18.106.045(C) were modified. <br /> G. Modified the word, "any' to, "all' in PMC §18.106.040(0) and PMC <br /> §18.106.045(D). <br /> GENERAL PLAN CONFORMITY <br /> The City's General Plan includes the following policies to encourage ADUs: <br /> Housing Element Actively promote the creation of second units on single-family <br /> Policy 6 residential lots and their maintenance as sources of housing <br /> affordable to moderate-, low-, and very low-income households. <br /> Housing Element Conduct a review of the Second Unit Ordinance, including a survey <br /> Program 6.3 of similar requirements in other Bay Area cities. Using this review, <br /> consider allowing second units without an Administrative Design <br /> Review process in new single-family developments, subject to <br /> performance standards, consider reducing the existing Second Unit <br /> Ordinance requirements, such as the parking and height limit <br /> requirements, to encourage the development of second units, <br /> consider other measures to promote the creation of second units, <br /> and adopt necessary changes as appropriate. <br /> The amendments to the PMC would support and further these General Plan policies. <br /> CONCLUSION <br /> The proposed text amendments will facilitate the development of ADUs and make the <br /> PMC consistent with State law and integrate the direction provided by City Council on <br /> January 19 and February 16. <br /> Page 3 of 4 <br />
