THE CITY OF 1 4 <br /> :; -'••' CITY COUNCIL AGENDA REPORT <br /> pLEASANTON,; <br /> March 2, 2021 <br /> Community Development <br /> TITLE: CONSIDER SECOND READING AND ADOPTION OF ORDINANCE NO. <br /> 2213 APPROVING AMENDMENTS TO CHAPTERS 18.08, 18.28, 18.32, <br /> 18.36, 18.44, 18.46, 18.84, 18.88 AND 18.106 OF THE PLEASANTON <br /> MUNICIPAL CODE TO COMPLY WITH STATE LEGISLATION FOR <br /> ACCESSORY DWELLING UNITS <br /> SUMMARY <br /> At its February 16, 2021, meeting, the City Council introduced Ordinance No. 2213, with <br /> modifications, to amend the Pleasanton Municipal Code (PMC) to align the code with <br /> recently adopted State law regarding accessory dwelling units (ADUs) but directed staff <br /> to make further modifications regarding ADUs in new PUDs, street side setbacks for <br /> detached ADUs greater than 800 square feet, fencing and landscaping requirements, <br /> owner occupancy requirements, and square footage maximums. The City Council also <br /> directed that staff provide the Council with updates (and modifications to the code if <br /> necessary) within a year and to further research the potential for creating preapproved <br /> designs for ADUs. The City Council, on January 19, 2021, had previously directed staff <br /> to revise the ordinance to limit two-story ADUs. A series of text revisions and <br /> clarifications related to this direction, was also reviewed and approved by the City <br /> Council. <br /> At this meeting, the City Council will consider second reading and adoption of the <br /> ordinance. Attachment 1 to this agenda report is the ordinance and amendments to the <br /> PMC, reflecting the changes as directed by City Council (the changes made to the <br /> ordinance since the February 16 meeting are discussed in detail below). <br /> RECOMMENDATION <br /> 1. Find that the proposed amendment to the Municipal Code is statutorily exempt from <br /> the provisions of the California Environmental Quality Act (CEQA) pursuant Public <br /> Resources Code Section 21080.17 and categorically exempt per CEQA Guidelines <br /> Section 15303; and <br /> 2. Waive second reading and adopt Ordinance No. 2213, find the subject code <br /> amendment consistent with the General Plan, and approve Case P20-0412, <br /> amendment to the Pleasanton Municipal Code as shown in Attachment 1. <br /> FINANCIAL STATEMENT <br /> No fiscal impact to the City or public service is anticipated with this amendment to the <br /> municipal code. <br />
