BACKGROUND <br /> The LPFD Fire Station No. 3 was constructed in 1969. The old building is beyond its <br /> useful life, and the project to raze the old building and construct a new, modern fire <br /> station in its place is currently underway. Working with PG&E during the design of the <br /> new building, PG&E identified the equipment that they must install to provide utilities to <br /> the new building's systems. While the new building includes all the functional <br /> components needed by the fire service, another goal of the design is to make the public <br /> building attractive from the exterior for all motorists and pedestrian traffic. As the <br /> property at the intersection of West Las Positas and Santa Rita Road is fairly small and <br /> the new building is fairly close to the property lines, the needed PG&E equipment was <br /> thought to be obtrusive and not compatible with the aesthetic goals of the project. City <br /> staff provided PG&E a location on the site what would meet PG&E needs, not interfere <br /> with the station operations, and be less visible than the adjacent public right-of-way. <br /> PG&E indicated that the selected location was acceptable, but that they would require <br /> an easement across the site to the selected location, giving them rights to install their <br /> facilities on the private property. <br /> DISCUSSION <br /> PG&E has agreed to locate the needed equipment as requested. However, PG&E <br /> requires an easement since the requested location is on private property. The easement <br /> will give PG&E rights to construct and maintain their equipment within the easement <br /> area. But more importantly from PG&E's perspective is that the easement affirmatively <br /> grants PG&E rights to locate their equipment on private property as is requested. The <br /> easement protects PG&E from being asked at any time in the future to relocate their <br /> equipment at their expense should the City decide to do something different with the <br /> property. While the scenario is unlikely, should it occur, PG&E would be required to <br /> remove or relocate their equipment as requested, but the expense to do so would be <br /> borne by the City. <br /> Staff recommends that the City Council adopt the resolution authorizing the Mayor of <br /> the City of Pleasanton to execute the grant of the Utility Distribution Easement to PG&E <br /> as proposed. <br /> Submitted by: Fiscal Review: Approved by: <br /> 4,4.7 <br /> Stephen Kirkpatrick Tina Olson Nelson Fialho <br /> Director of Engineering Director of Finance City Manager <br /> Attachments <br /> 1.
