§5. ISSUANCE OF CERTIFICATE. If the City Council finds that <br />further taxicab service in the City of Pleasanton is required by <br />the public convenience and necessity and that the applicant is fit, <br />willing, and able to perform such public transportation and to <br />conform to the provisions of this Ordinance and any and all rules <br />promulgated by the Police Chief, then the City Council shall by <br />resolution declare that the public convenience and necessity re- <br />quire additional taxicab service and that a Certificate be issued <br />by the Police Chief stating the name and address of the applicant, <br />the number of vehicles authorized under said Certificate, the <br />location of a closed stand for the applicant's use, and the date <br />of issuance; otherwise, the application shall be denied. In making <br />the above finds, the City Council shall take into consideration <br />the following: <br /> <br /> a) The number of taxicabs already in operation° <br /> b) Whether existing transportation is adequate to meet <br /> the public need. <br /> c) The probable effect of increased service on local <br /> traffic conditions. <br /> d) The character, experience, and responsibility of the <br /> applicant. <br /> e) All the information contained in the verified <br /> application for a Certificate and the Report and <br /> Findings of the Police Chief. <br /> f) Engineering factors related to the roposed location <br /> of a closed stand for the applicant~s exclusive use. <br /> g) All other such information or material that the <br /> City Council deems pertinent' to the issuance of a <br /> Certificate. <br /> <br /> §5.1. EFFECT ON CURRENT OWNERS. Every owner operating a <br />taxicab under permission of the City Council prior to the effective <br />date of this Ordinance shall be presumed to have established prima <br />facie evidence of public convenience and necessity for his taxi- <br />cabs actually in operation, and the City Council, upon written <br />request by him not later than 15 days after the effective date of <br />this Ordinance, shall, by resolution, authorize the Police Chief <br />to issue a Certificate to such owner for such taxicabs. <br /> <br /> §6. INDEMNITY BOND OR LIABILITY INSURANCE REQUIRED. After <br />the City Council has authorized the issuance of a Certificate; <br />but before the Police Chief actually shall issue the Certificate, <br />there shall be in full force and effect an indemnity bond for each <br />vehicle of all owners authorized in the amount of at least one- <br />hundred thousand dollars ($100,000.00) for bodily injury to any <br />one person, in the amount of at least three-hundred thousand <br />dollars ($300,000.00) for injuries to more than one person which <br />are sustained in the same accident; and ten-thousand dollars <br />($10,000.00) for property damage resulting from any one accident. <br />Said bond or bonds shall inure to the benefit of any person who <br />shall be injured or who shall sustain damage to property proximate] <br />caused by the negligence of a holder, his servants, or agents. <br />Said bond or bonds shall be filed in the Office of the Police Chief <br />and shall have as surety thereon a surety company authorized to do <br /> --- -'- ~ ~ n~ California. <br /> <br /> <br />
