Attachment 1 <br /> MEMORANDUM OF UNDERSTANDING BETWEEN <br /> THE CITY OF PLEASANTON AND <br /> THE PLEASANTON UNIFIED SCHOOL DISTRICT <br /> FOR USE OF CITY AND DISTRICT FACILITIES FOR <br /> EMERGENCY AND DISASTER RELATED ACTIVITIES <br /> THIS MEMORANDUM OF UNDERSTANDING ("MOU") is entered into between the <br /> CITY OF PLEASANTON, a municipal corporation("City"), and the PLEASANTON UNIFIED <br /> SCHOOL DISTRICT("District"),each also individually referred to as "Party" and collectively <br /> referred to as the "Parties". <br /> RECITALS <br /> WHEREAS, City is dedicated to providing efficient, coordinated response to any <br /> emergency or disaster and/or unusual occurrences that could threaten the well-being and health <br /> of residents and visitors to the Pleasanton community. Disaster coordination and management <br /> will involve all affected city departments and any other related city, county, state, federal, private <br /> sector or non-profit agencies that can assist in providing resources and recovery related to <br /> disaster preparedness. These occurrences include, but are not limited to earthquakes, landslides, <br /> fires, floods, terrorism, nuclear incidents, hazardous material incidents, disease outbreak, civil <br /> disturbance, criminal mass-casualty incidents, or any other emergency requiring a coordinated, <br /> multi-agency response. Furthermore,the Pleasanton City Council adopted Resolution No. 18- <br /> 1006, approving the City Emergency Operation Plan Update; and <br /> WHEREAS, California Education Code §32282 Interagency School Safety <br /> Demonstration Act of 1985, encourages school districts "Establishing a procedure to allow a <br /> public agency, including the American Red Cross, to use school buildings, grounds, and <br /> equipment for mass care and welfare shelters during disasters or other emergencies affecting the <br /> public health and welfare. The school district or county office of education shall cooperate with <br /> the public agency in furnishing and maintaining the services as the school district or county <br /> office of education may deem necessary to meet the needs of the community."; and <br /> WHEREAS, City and District have facilities, listed in the attached Exhibit A, which may <br /> be appropriate for use in emergency or disaster situations; and <br /> WHEREAS, if such facilities are so needed for an emergency or disaster, City and <br /> District would consider entering into a Facility Use Agreement with the American Red Cross, a <br /> sample of which is attached in Exhibit B. <br /> NOW, THEREFORE,the Parties agree as follows: <br /> 1 <br />
