Weather protection devices such as measures to protect pipes from freezing shall require <br />approval by the Planning Director prior to use; at no time shall fabric or other material <br />not designed and/or intended for this purpose be wrapped around or otherwise placed on <br />these devices. All backflow prevention devices shall be shown on the plans submitted for <br />issuance of building permits together with screening mechanism and/ or weather <br />protection devices. Proposed screening and weather protection devices shall be reviewed <br />for conformity to these requirements and approved by the Planning Director prior to <br />issuance of a building permit. <br /> <br />Existing Trees: <br /> <br />47. <br /> <br />The project developer shall comply with the "Tree Preservation Guidelines" of the tree <br />report prepared by HortScience, Inc. dated March 5, 2003. No tree trimming or pruning <br />other than that specified in the tree report shall occur. The project developer shall <br />arrange for the horticultural consultant to conduct a field inspection prior to issuance of <br />grading permits to ensure that all recommendations have been properly implemented. <br />The consultant shall certify in writing that such recommendations have been followed. <br /> <br />48. <br /> <br />The applicant shall modify the proposed improvements (paving, grading, utilities, <br />landscape, etc.), as deemed necessary by the Planning Director, to ensure that Fremont <br />cottonwood trees Nos. 752, 754, and 755 (as specified in the tree report) can be saved and <br />to ensure their longevity at the site. <br /> <br />49. <br /> <br />No trees shall be removed other than those specifically designated for removal on the <br />approved plans or tree report. The applicant shall be responsible for the loss of any tree <br />not previously approved for removal. The applicant shall post cash, letter of credit, <br />certificate of deposit (CD), or other security satisfactory to the Planning Director in the <br />mount of $5,000 for each tree required to be preserved, up to a maximum of $25,000. <br />This cash bond or security shall be retained for one year following completion of <br />construction and shall be forfeited if the trees are removed, destroyed, or disfigured. For <br />trees that are removed, destroyed, or disfigured during construction, the applicant shall <br />pay a fme in the amount equal to the appraised value of the subject tree. If the f'me based <br />on the appraised value of the tree(s) exceeds the bond amount, the applicant shall pay the <br />difference between the bond and the appraised value of the subject tree(s). <br /> <br />50. <br /> <br />Protective chain link or securely staked nylon fencing shall be installed around the <br />existing trees to be saved during all construction activities. The location of said fencing <br />shall be subject to the review and approval of the Planning Director.
