a. The applicant shall utilize its best efforts to locate any new utility trenches outside the <br /> dripline of the trees to be saved. <br /> <br />No oil, gasoline, chemicals, or other harmful materials shall be deposited or disposed <br />within the dripline of the existing tree or in drainage channels, swales, or areas that <br />may lead to the dripline. <br /> <br />c. No signs, wires, or ropes shall be attached to the existing trees. <br /> <br />d. No stockpiling/storage of construction materials, fill, etc., shall take place underneath <br /> or within 5' of the dripline of the existing trees. <br /> <br />e. No equipment or temporary structures shall be placed within or beneath the driplines <br /> of the existing trees. <br /> <br />Failure to comply with these requirements may result in a stop-work order. <br /> <br />Landscaping and Irrigation System Design and Operation: <br /> <br />51. <br /> <br />The project developer shall enter into an agreement with the City, approved by the City <br />Attorney, which guarantees that all landscaping and open space areas included in this <br />project will be maintained at all times in a manner consistent with the approved landscape <br />plan for this development. Said agreement shall run with the land for the duration of the <br />existence of the structures located on the subject property. <br /> <br />52. <br /> <br />The applicant shall use its best efforts to secure approvals from Alameda County to <br />landscape (including an automatic irrigation system) the Stanley Boulevard median from <br />the Shadow Cliffs Park main driveway at Stanley Boulevard to the western end of the <br />Shadow Cliffs Park property fronting Stanley Boulevard. The applicant shall be subject <br />to the terms and conditions that the County determines in order to allow the landscaping <br />to be installed in its right-of-way. The landscaping and irrigation system shall also be <br />designed consistent with City standards to allow City maintenance. Installation of the <br />landscaping shall be contingent upon the City approving the terms and conditions for its <br />maintaining the median within the jurisdiction of Alameda County. If all necessary City <br />and County approvals are obtained to install the landscaping, the applicant shall install <br />the landscaping and irrigation system in conjunction with the water park improvements. <br /> <br />53. <br /> <br />A final landscape plan and irrigation plan shall be submitted to and approved by Planning <br />Director as part of the building permit plan set prior to issuance of an on-site permit. <br />Said landscape plan shall be consistent with the approved landscape plan plus any <br /> <br />PCUP-63/PDR-243 Conditions of Approval Page 11 <br /> <br /> <br />
