EXHIBIT C <br /> 1 �C <br /> August 18, 2020 <br /> Ms.Melinda Denis <br /> Planning Manager <br /> City of Pleasanton <br /> 200 Bernal Avenue <br /> Pleasanton, California 94566 <br /> Re: Conditional Use Permit <br /> Crosspoint Church Preschool of Pleasanton <br /> Site 172,Diablo North <br /> Dear Melinda: <br /> This letter is being provided in accordance with the Declaration of Covenants,Conditions and Restrictions for Hacienda,Article III,Section <br /> 3.2, Paragraph 3.2.3, Plan Changes and Plans for Changes to Improvements. The Design Review Committee for the Hacienda Owners <br /> Association has reviewed an application for a conditional use permit.This application was submitted by Crosspoint Chinese Church of Silicon <br /> Valley,Site 172,dated June 24,2020.This modification is in substantial compliance with the guidelines set forth in the Design Guidelines <br /> and Covenants, Conditions and Restrictions. <br /> The proposed conditional use permit will allow Crosspoint Church Preschool of Pleasanton to operate a bilingual preschool at 5627 Gibraltar <br /> Drive,Suite 100.The school will be open from 7:00 am to 6:00 pm Monday through Friday.A maximum of 49 students and 6 teachers and <br /> administrative staff are proposed for the school.In consideration of the conditional use permit,the applicant has reviewed site parameters <br /> of concern including:parking,traffic and noise. Based on a comprehensive review of space allocation and business practice,the applicant <br /> has demonstrated that their use is compatible with currently approved uses. The description of the use proposal for this modification is <br /> attached. <br /> Approval of this use is specifically conditioned on its conformance with the operational plan and supplemental materials provided. The <br /> Hacienda Owners Association reserves the right to require the operator of any use described under this approval to perform one-time or <br /> periodic monitoring and verification of the conditions outlined in the operational plan and supplemental materials,using means and methods <br /> of the Hacienda Owners Association's choosing,if there is reasonable reason to believe that conformance with the approved operation is <br /> in question.The Hacienda Owners Association further reserves the right to modify or revoke approval of this use at this location if,following <br /> a noticed meeting at which the operator or project representative will be given an opportunity to present their position on the issue,it is <br /> demonstrated that compliance has not been achieved. <br /> This application is hereby approved by the Hacienda Owners Association and may be processed for necessary approvals by the City of <br /> Pleasanton. If this is not feasible, the applicant shall submit a report from a <br /> certified arborist acceptable to the City indicating trenching will not be detrimental to <br /> the health of the tree. <br /> c. Nothing may be stored within the dripline of the tree canopies. This includes <br /> equipment, oil, gas, chemicals, harmful materials, fill or storage. <br /> d. No oil, gasoline, chemicals, or other harmful materials shall be deposited or disposed <br /> within the dripline of the trees or in drainage channels, swales, or areas that may lead <br /> to the dripline. <br /> e.
