the building and Chick-fil-A. Mr. Tassano stated the City would not normally construct a court <br /> so close to a major arterial intersection. He expressed agreement with Commissioner Allen <br /> and stated he wanted to make sure the same thing that happened at Chick-fil-A did not happen <br /> at the former Denny's site. He stated his goal was to resolve Chick-fil-A and then have the <br /> former Denny's site address their issues, should they come up. <br /> Chair Ritter asked about the traffic that may occur once Costco was constructed. Mr. Tassano <br /> stated staff did not normally expect or account for on-street congestion from a private <br /> development; he stated staff would work to resolve continued traffic issues with Chick-fil-A. <br /> Hopyard Road at Owens Drive <br /> Commissioner O'Connor asked how far back the turn lane would start and if the protected <br /> shoulder would be removed. Mr. Tassano confirmed the protected shoulder would be <br /> eliminated and indicated how far back the turn lane would start and that the median would be <br /> modified. Commissioner O'Connor then inquired about how much of the cycle path was <br /> elevated and Mr. Tassano responded six inches. Commissioner O'Connor further inquired <br /> about the shoulder and Mr. Tassano stated there was no shoulder. Commissioner O'Connor <br /> expressed concern there was no vehicular shoulder. Mr. Tassano discussed the difficulty in <br /> balancing the number of vehicle breakdowns versus bicyclists. <br /> Chair Ritter asked if the roadway construction would occur during the construction of Costco. <br /> Mr. Tassano stated he was not sure of Costco's schedule. <br /> Commissioner Allen asked the City's process for going back to a developer to look for <br /> additional traffic impact fees if the project was more impactful than expected. Mr. Tassano <br /> explained collection of retail fees per number of trips. He discussed the anomaly with retail <br /> trips and stated there was no way to post-collect fees. <br /> Ms. Denis asked if the driveway for Burger King and the former Specialty's Restaurant would <br /> remain open. Mr. Tassano confirmed. Ms. Denis then asked if staff had studied closing off the <br /> driveway. Mr. Tassano stated it would be difficult eliminating access points that have already <br /> been established. <br /> Commissioner Brown brought up the traffic at the intersection of Hopyard Road at Owens <br /> Drive and asked if the replacement of the Specialty's restaurant would cause more congestion <br /> at the intersection. Mr. Tassano agreed the area could be precarious to navigate, and stated <br /> the solution would be to post 'Do Not Enter' signs so as not to allow vehicles to enter in that <br /> direction, which was not normally done unless there was a problem on the street. <br /> Commissioner Brown stated it could be addressed when a new business entered the former <br /> Specialty's Restaurant site. Mr. Tassano stated the only way the City could change it was if <br /> something new was going in that space. Ms. Denis clarified the driveway was owned by the <br /> Burger King property and it could be reviewed if Burger King redeveloped.
