Pleasanton Police Department <br />Pleasanton PD Policy Manual <br />Body Worn Camera Systems <br />d) Prior to being interviewed in an internal departmental administrative investigation (i.e., internal <br />affairs investigations) only with the prior approval of the Division Commander, except as required <br />by the Peace Officer Bill of Rights Act (POBRA). <br />e) Upon request, in order to assist in responding to a public records request. <br />f) Members may not view another member's BWCS recordings relating to an incident in which <br />they did not personally participate or are actively investigating, without the approval of the Division <br />Commander. <br />g) For use in social media for the purposes of investigation, community safety or suspect <br />apprehension only with permission of the Division Commander. <br />h) Officers involved in a critical incident (i.e., officer -involved shooting, use of force, in custody <br />death, vehicular collision causing injuries.) may be permitted to review their own BWCS recordings <br />of the incident prior to providing a statement or written report as determined by the Division <br />Commander. There may be instances where permission will not be granted, such as prior to <br />obtaining a public safety statement following a critical incident. <br />All BWCS records should be reviewed by the Custodian of Records prior to public release. <br />Recordings that contain recordings of matters that would normally be considered private and/ <br />or personal outside the context of law enforcement investigation and which show an extremely <br />violent or graphic scene should not be publically released unless disclosure is required by law or <br />order of the court. <br />450.9 RETENTION POLICY <br />Recorded data including video and audio recorded by a BWCS shall be retained minimally as <br />outlined below: <br />Primary - Officer Categorization <br />(a) Detentions/Searches - 2 years (Detentions and or searches not associated with an <br />arrest or criminal investigation) <br />(b) Felony Case - 2 years or after the statute of limitations has expired, generally 3-10 <br />years (PC 800-806) <br />(c) Misdemeanor Case - 2 years or after the statute of limitations has expired, generally <br />3-10 years (PC 800-806) <br />(d) Incident - 2 years <br />(e) Pending Review - 2 years <br />Secondary - Supervisor Categorization <br />(a) Administrative File - 2 years or until transferred to a completed case <br />file.
