Pleasanton Police Department <br />Pleasanton PD Policy Manual <br />Body Worn Camera Systems <br />450.5 OPERATION <br />While on duty, members are required to keep the BWCS in the "ON" position and in "buffering <br />mode" except for the following circumstances: <br />• When out of service during an authorized break. <br />• When inside police department, except where a member is in contact with a member <br />of the public and the contact appears to be escalating to an adversarial situation or <br />conducting investigative activities involving contact with the public (i.e. interviewing <br />victims and/or witnesses). <br />• While using the restroom. <br />While "buffering mode" is not actively recording, members are advised that the BWCS will capture <br />30 seconds of video preceding the activation of the BWCS. <br />450.6 PRIVACY AND OWNERSHIP EXPECTATION <br />All recordings made by members acting in the course and scope of their duties as a City employee <br />shall remain the property of the Department regardless of whether those recordings were made <br />with department -issued or authorized personally -owned recorders. Members have no expectation <br />of privacy or ownership interest in any such recordings. <br />450.7 NON -CRIMINAL MATTER <br />Whenever members operating BWCS reasonably believe that a recorded contact may be of <br />benefit in a non -criminal matter (i.e., a hostile contact), the officer or supervisor may copy the <br />recorded media onto a disk and shall book the copy into evidence for safekeeping in addition to <br />uploading the file into the database. <br />450.8 REVIEW OF RECORDED FILES <br />Although the data captured by the BWCS is not considered Criminal Offender Record Information <br />(CORI), it shall be treated in the same manner as CORI data. All access to the Evidence.com is <br />logged and subject to audit at any time. Members seeking to review BWCS recordings shall log the <br />reason for access in the "Notes" section (access to automatically time/date stamped and records <br />each access by name). Access to the data from the system is permitted on a right to know, need <br />to know basis pursuant to (CCR, Title 11, Division 1, Chapter 7, Article 1, Section 702). <br />Members may view the audio/video data captured on their BWCS under the following <br />circumstances: <br />a) For the purpose of completing a criminal investigation and preparing reports. <br />b) Prior to or during preparation for testifying in any deposition, before any court or administrative <br />agency (i.e., DMV, ABC) or for courtroom presentation pursuant to direction of the District Attorney <br />or Department legal counsel or where authorized by the Supervisor. <br />c) For individual training purposes, with the authorization of a supervisor, or by an FTO when <br />providing training to a Trainee. <br />Copyright Lexipol, LLC 2020/09/22, All Rights Reserved.
