18.106.060 Required standards for all accessory dwelling units. <br /> All accessory dwelling units shall meet the following standards: <br /> A. <br /> party. The For accessory dwelling units approved between January 1,2020 and January 1,2025,a <br /> property owner may rent both the primary residential unit and the accessory dwelling,as long as the <br /> rental periods are longer than thirty days . •- - -•_ .. - . •- . •- . . . - . <br /> unit(s)or portion(s)thereof. The owner shall be a signatory to any lease for the rented unit, for which <br /> the city may reasonably require a copy of to verify compliance with this chapter, and shall be the <br /> applicant for any permit issued under this chapter. <br /> B. The accessory dwelling unit shall not be sold or held under a different legal ownership than the <br /> primary residence; nor shall the lot containing the accessory dwelling unit be subdivided. <br /> C. The following objective standards shall apply to accessory dwelling units: <br /> 1. Additions to accessory structures of 150 square feet or less beyond the existing physical <br /> dimensions,to accommodate ingress/egress to an accessory dwelling unit or junior <br /> accessory dwelling unit are allowed. <br /> 2. The following standards apply to accessory dwelling units proposed on a second story of an <br /> existing primary residential unit,multifamily development,or detached garage. <br /> a. An accessory dwelling unit proposed as a second-story addition to a main structure <br /> must meet setback, height, floor-area-ratio,building separation and other <br /> development standards applicable to the main structure for the zoning district <br /> within which the accessory dwelling unit is proposed. <br /> b. An accessory dwelling unit constructed above a detached garage must meet the <br /> standards identified in Section 18.106.045. <br /> c. The accessory dwelling unit must be designed such that operable windows or <br /> windows required for emergency egress face away from the neighboring <br /> property(ies) that share property lines with the subject property when proposed on <br /> a lot with a single-family residence,and must face the existing multifamily dwellings <br /> when proposed on a lot with a multifamily development. Facades of the accessory <br /> dwelling unit that face neighboring properties with shared property lines may only <br /> have clerestory windows(i.e.with a window sill height at least 6 feet above finished <br /> floor). If strict application of the preceding requirements would not allow the unit <br /> to meet Building or Fire Code requirements for egress or ventilation and the <br /> windows facing neighboring properties that share property lines with the subject <br /> property are proposed where the sill height is less than 6 feet above finished floor, <br /> the glazed portion of the windows must be of obscured glass. <br /> d.
