~and preservation of such hereinafter described "heritage'~ trees <br />iiwithin the City of Pleasanton. <br />i$Section 2-17.02 Tree Defined as used in this Chapter a tree shall <br />~,mean any live woody plant having one or more well defined <br /> <br /> ,perennial stems~ . <br />I!Section 2-17.03 Heritage Tree Defined as used in this Chapter, <br /> <br />i'heritage tree" shall mean any of the following: <br />i~ 1. Any tree with a circumference of forty (40) inches <br />~! or more measured two and one~-half feet above ground <br />,. level <br /> <br />ii 2. Any tree thirty-five feet or more in height. <br />t; 3. Any tree of particular historical significance <br />fi specifically designated by official action. <br />~i 4. A stand of trees the nature of which makes each <br /> <br /> . dependent upon the others for survival. <br /> <br /> iSection 2-17.04 Exceptions The provisions of this Chapter <br /> <br />!shall not apply to fruit or, when part of an orchard, to nut <br />~',bearing trees the product of which is used for commercial <br /> <br />!~purpos es . <br /> <br /> Article 2 <br /> Permit Procedure <br /> <br />~Section 2-17.05 Permit required <br /> <br />![No person shall cut down, destroy or remove any heritage tree <br />i!growing within the City limits from any property without a <br />~permit except as provided herein. <br /> <br />iiSection 2-17.06 Permit Procedures <br />i~Any person desiring to cut down, destroy or remove one or more <br />iiheritage trees on any property in the City of Pleasanton shall <br />~make application to the Director of Recreation· Said application <br /> <br /> shall contain the number, species, size and location of trees <br /> <br />,to be cut down, destroyed or removed and a brief statement of <br /> <br /> ~the reason for removal as well as any other pertinent information <br /> ihe may require. The permit, if granted, shall entitle the <br /> applicant to remove one or more designated trees existing on <br /> <br /> <br />
