The proposed conditional use will comply with each of the <br />applicable provisions of the Zoning Ordinance. <br />The proposed park-n-sell car lot, although located on BART property, is not <br />directly associated with BART operations. Requiring a use permit process <br />has allowed the City to thoroughly analyze potential impact of the proposed <br />use and seek comments from the public, other City departments, and other <br />public agencies. Granting a conditional use permit would be consistent with <br />the City's ability to regulate related zoning regulations. <br />WHEREAS, the Planning Commission determined that the proposed use can be <br />accommodated without creating adverse impacts on the adjacent businesses. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br />Section 1. Approves Case PCUP-96, the application of Robert Morris for conditional use <br />permit approval to operate a weekend "park-n-sell" car lot on the Pleasanton- <br />Dublin BART station parking lot located at 5835 Owens Drive, subject to the <br />conditions shown in Exhibit "B," attached hereto and made part of this case by <br />reference. <br />Section 2.
