PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION N0. PC-2003-44 <br />RESOLUTION APPROVING THE APPLICATION OF ROBERT MORRIS <br />FOR CONDITIONAL USE PERMIT APPROVAL, AS FILED UNDER CASE <br />PCUP-96 <br />WHEREAS, Robert Morris has applied for conditional use permit approval to operate a <br />weekend "park-n-sell" car lot on the Pleasanton-Dublin BART station <br />parking lot located at 5835 Owens Drive; and <br />WHEREAS, zoning for the property is PUD-I/C-O (Planned Unit Development - <br />Industrial/Commercial-Office) District; and <br />WHEREAS, at its duly noticed public hearing of October 8, 2003, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br />WHEREAS, projects of this nature are categorically exempt from the requirements of <br />the California Environmental Quality Act (CEQA); and <br />WHEREAS, the Planning Commission made the following findings: <br />The proposed location of the conditional use is in accordance with <br />the objectives of the zoning ordinance and the purpose of the <br />district in which the site is located. <br />The proposed park-n-sell car lot is aweekend-only business. Its operation <br />should not affect the regular BART operation, nor should it affect the <br />operation of the adjacent office uses since they are generally not open on <br />weekends. The proposed park-n-sell car lot, if managed in the manner as <br />stated in the business operation narrative would be consistent with the <br />objectives for this zoning district. <br />2. The proposed location of the conditional use and the conditions <br />under which it would be operated or maintained will not be <br />detrimental to the public health, safety, or welfare, or materially <br />injurious to the properties or improvements in the vicinity. <br />The subject site has adequate and safe ingress and egress, which should <br />not impact adjacent businesses. If operated properly and all the proposed <br />conditions are met, the proposed use would be suitable for the subject site. <br />
