PLANNING COMMISSION CITY OF PLEASANTON
ALAMEDA COUNTY, CALIFORNIA
RESOLUTION N0. PC-2003-44
RESOLUTION APPROVING THE APPLICATION OF ROBERT MORRIS
FOR CONDITIONAL USE PERMIT APPROVAL, AS FILED UNDER CASE
PCUP-96
WHEREAS, Robert Morris has applied for conditional use permit approval to operate a
weekend "park-n-sell" car lot on the Pleasanton-Dublin BART station
parking lot located at 5835 Owens Drive; and
WHEREAS, zoning for the property is PUD-I/C-O (Planned Unit Development -
Industrial/Commercial-Office) District; and
WHEREAS, at its duly noticed public hearing of October 8, 2003, the Planning
Commission considered all public testimony, relevant exhibits, and
recommendations of the City staff concerning this application; and
WHEREAS, projects of this nature are categorically exempt from the requirements of
the California Environmental Quality Act (CEQA); and
WHEREAS, the Planning Commission made the following findings:
The proposed location of the conditional use is in accordance with
the objectives of the zoning ordinance and the purpose of the
district in which the site is located.
The proposed park-n-sell car lot is aweekend-only business. Its operation
should not affect the regular BART operation, nor should it affect the
operation of the adjacent office uses since they are generally not open on
weekends. The proposed park-n-sell car lot, if managed in the manner as
stated in the business operation narrative would be consistent with the
objectives for this zoning district.
2. The proposed location of the conditional use and the conditions
under which it would be operated or maintained will not be
detrimental to the public health, safety, or welfare, or materially
injurious to the properties or improvements in the vicinity.
The subject site has adequate and safe ingress and egress, which should
not impact adjacent businesses. If operated properly and all the proposed
conditions are met, the proposed use would be suitable for the subject site.
