EXHIBIT A <br /> RESOLUTION NO. PC-2020-06 <br /> A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF <br /> PLEASANTON APPROVING THE APPLICATION FOR CONDITIONAL USE PERMIT <br /> (CUP) LOCATED AT 5860 OWENS DRIVE, AS FILED UNDER CASE NO. P20-0350 <br /> WHEREAS, on February 6, 2020, Kurt Hereld, representing Chabot Los Positas <br /> College Community District, applied for Conditional Use Permit approval to operate a <br /> trade school with more than 20 students on the third floor of 5860 Owens Drive; and <br /> WHEREAS, zoning for the property is PUD-I/C-O (Planned Unit Development - <br /> Industrial/Commercial and Office) District; and <br /> WHEREAS, a trade school with more than 20 students is a conditionally <br /> permitted use in the subject District, and requires Planning Commission approval of a <br /> CUP; and <br /> WHEREAS, the project is categorically exempt from the California Environmental <br /> Quality Act (CEQA) pursuant to Section 15301, Class 1, Existing Facilities; and <br /> WHEREAS, on April 1, 2020, the Planning Commission held a duly-noticed <br /> public hearing and considered relevant exhibits, recommendations of the City staff <br /> concerning this application, and received testimony from the applicant and interested <br /> parties. <br /> NOW, THEREFORE BE IT RESOLVED by the Planning Commission of the City <br /> of Pleasanton, based on the entire record of proceedings, including the oral and written <br /> staff reports and all public comment and testimony: <br /> Section 1: Findings for Conditional Use Permit Approval <br /> With respect to the approval of P20-0350, the Planning Commission makes the <br /> following findings as required by Section 18.124.070 of the Pleasanton Municipal Code: <br /> A. That the proposed location of the conditional use is in accordance with the <br /> objectives of the zoning ordinance and the purpose of the district in which <br /> the site is located. <br /> Some of the objectives of the zoning ordinance are to: foster a harmonious, <br /> convenient, workable relationship among land uses, protect existing land uses <br /> from inharmonious influences and harmful intrusions, and ensure public and <br /> private lands ultimately are used for the purposes which are most appropriate <br /> and beneficial to the City as a whole. As conditioned, the Planning Commission <br /> finds the proposed trade school would be consistent with these objectives and <br /> would create more educational facilities within the City. The facility would be <br /> operated to not impact or interfere with the surrounding uses in that the activities, <br /> number of students and staff, and hours of operation would not generate <br /> substantial noise, parking demand, or traffic. <br />h in the CC&R's (Covenants, Conditions and <br /> P20-0350, 5860 Owens Drive, 3rd Floor Planning Commission <br /> 8 of 9 <br />school requires 45 parking spaces for <br /> its 90 adult students, and 13 spaces for its 13 teachers/administrative staff members, a total of <br /> 58 parking spaces. This assumes that all five classrooms and the computer lab are occupied <br /> simultaneously with 15 students in each. However, in reality this would not occur due to <br /> staggering of the classes. The office spaces on the third floor for Administrative & Fiscal <br /> Agency, Apprenticeship, Contract Education, Title IV Childcare and Tri-Valley Career Center <br /> require 45 spaces (13,513 square feet/300 gross square feet). A total of 103 spaces will be <br /> required for the third floor, which includes 58 spaces for the trade school and 45 spaces for the <br /> office space. The medical office on the first-and-second floors requires 195 spaces <br /> (48,800 square feet/250 gross square feet) and the office on the fourth floor requires <br /> 74 spaces (22,320 square feet/300 gross square feet). <br /> P20-0350, 5860 Owens Drive, 3rd Floor Planning Commission <br /> 7 of 9 <br />
