ORDER OF THE DIRECTOR OF EMERGENCY SERVICES FOR THE <br /> CITY OF PLEASANTON <br /> WAIVING CERTAIN FINES, PENALTIES AND INTEREST PAYMENTS <br /> AND SUSPENDING CERTAIN REQUIRED SECURITY DEPOSITS <br /> BECAUSE OF THE <br /> COVID-19 NATIONAL, STATE, AND LOCAL EMERGENCY <br /> A. On March 13, 2020, the federal government adopted a Proclamation on <br /> Declaring a National Emergency Concerning the Novel Coronavirus Disease (COVID- <br /> 19) Outbreak. <br /> B. On March 4, 2020, California Governor Gavin Newson proclaimed a State <br /> of Emergency to exist in California as a result of the threat of COVID-19. <br /> C. On March 17, 2020, under the authority contained in California <br /> Government Code section 8634 and Chapter 2.44 of the Pleasanton Municipal Code, I <br /> declared the existence of a local emergency in the City of Pleasanton ("City"). <br /> D. On March 23, 2020, the City Council adopted a resolution ratifying the <br /> proclamation of the existence of a local emergency in the City (Resolution No. 20-1139). <br /> E. On April 2, 2020, California Governor Gavin Newson issued Executive <br /> Order N-42-20 prohibiting the discontinuation of water service to residential units and <br /> certain businesses for nonpayment of a bill for water service. <br /> F. The City's Municipal Code ("PMC") imposes fines, penalties, and interest <br /> when a responsible business owner, property owner, or resident does not pay the City's <br /> transient occupancy tax, or utility bills for water or sewer services provided by the City <br /> when due. <br /> G. The PMC also requires new applicants for water and sewer service to pay <br /> a security deposit. <br /> H. Many business owners, property owners, and residents may have difficulty <br /> timely paying the City's transient occupancy tax and utility bills for water and sewer, as <br /> well as making required security deposits for water service, due to loss of income, <br /> increased medical expenses or childcare needs due to COVID-19. <br /> I. Under the authority contained in California Government Code section <br /> 8634 and Chapter 2.44 of the PMC, I am empowered upon the proclamation of a local <br /> emergency to make and issue orders and regulations on matters reasonable related to <br /> the protection of life and property as affected by such local emergency. These orders <br /> and regulations are to be confirmed by the City Council at the earliest practicable time. <br />
