Associate Planner Eric Luchini responded that Beer Baron and McKay's Taphouse and Beer Garden, are permitted to have live entertainment and music seven days a week; although he's unsure whether McKay's Taphouse and Beer Garden are actually doing so at the present time. Planning and Permit Center Manager Melinda Denis clarified that McKay's is slightly different because their establishment is primarily outdoors, so the music is limited to an earlier hour, either 9 p.m. or 10 p.m. Beer Baron only has music indoors, and only until midnight on certain days of the week. Sidetrack Bar & Grill is also permitted to have live music until late hours, a limited number of days within the year. In response to a follow-up question from Commissioner Allen, Ms. Denis confirmed there are no other examples of downtown establishments who are permitted to have music and who operate until midnight, seven days a week. There may be others, e.g. Sunshine Saloon, outside the Downtown. Responding to Commissioner Brown, Mr. Luchini confirmed that the applicant is not requesting approval of outdoor dining at this time; but staff approval would be needed to add this component, versus Planning Commission modification of the CUP.
