8. Actions of the Zoning Administrator No action was taken. MATTERS INITIATED BY COMMISSION MEMBERS Commissioner Allen requested an update be provided for the Chick-Fil-A traffic queuing and the remedy to help minimize the queuing on Hopyard Road. Community Development Director Ellen Clark responded that staff would provide a status update regarding a resolution of the queuing issues at Chick-Fil-A. Commissioner Allen inquired on the status of the building for the Chabad of the Tri-Valley. Ms. Clark responded that the Chabad of the Tri-Valley has been in contact with staff regarding their landscape plans and they are moving forward with that process. Additionally, their use permit will expire in April 2020 and they will be applying for a one-year extension. Commissioner Allen inquired whether they started operation of the daycare portion of Chabad. Ms. Clark confirmed that the daycare is not allowed under the current Conditional Use Permit (CUP). Associate Planner Eric Luchini responded that Beer Baron and McKay's Taphouse and Beer Garden, are permitted to have live entertainment and music seven days a week; although he's unsure whether McKay's Taphouse and Beer Garden are actually doing so at the present time. Planning and Permit Center Manager Melinda Denis clarified that McKay's is slightly different because their establishment is primarily outdoors, so the music is limited to an earlier hour, either 9 p.m. or 10 p.m. Beer Baron only has music indoors, and only until midnight on certain days of the week. Sidetrack Bar & Grill is also permitted to have live music until late hours, a limited number of days within the year. In response to a follow-up question from Commissioner Allen, Ms. Denis confirmed there are no other examples of downtown establishments who are permitted to have music and who operate until midnight, seven days a week. There may be others, e.g. Sunshine Saloon, outside the Downtown. Responding to Commissioner Brown, Mr. Luchini confirmed that the applicant is not requesting approval of outdoor dining at this time; but staff approval would be needed to add this component, versus Planning Commission modification of the CUP.
