CONSENT CALENDAR - Consent Calendar items are considered routine and will be enacted by one <br /> motion unless a request for removal for discussion or explanation is received from the Planning <br /> Commission or a member of the public by submitting a speaker card for that item. <br /> 1. Approve the meeting minutes of January 15, 2020 (Item Continued to the March 11 <br /> Meeting) <br /> 2. PUD-89-06-08M, Gabriela Marks/Marks Architects, Inc. for Jinglebells LLC — <br /> Application for a Planned Unit Development (PUD) Major Modification to remove an <br /> existing PUD (PUD-89-6) condition of approval prohibiting a drive-through restaurant on <br /> "Pad B" within Phase III of the Rose Pavilion Shopping Center. The proposed modification <br /> would facilitate the demolition of an existing oil change facility and the construction of a new <br /> approximately 1,649-square-foot drive-through Taco Bell restaurant and related site <br /> improvements on "Pad B" located at 4210 Rosewood Drive. Zoning for the property is <br /> PUD-C (Planned Unit Development — Commercial) District. <br /> 3. P19-0432, Rick Dobbs/Middle 8 LLC — Application for a Conditional Use Permit (CUP) <br /> to: (1) operate a bar; and (2) allow indoor entertainment and music until midnight, seven <br /> days a week at 310 Main Street, Suite D. Zoning is C-C (Central Commercial), Downtown <br /> Revitalization, Active Ground-Floor Overlay, Core Area Overlay, Downtown Hospitality <br /> Central Core Area District. <br /> With respect to Item 3, Commissioner Allen referenced a question posed by Mike Cheney in <br /> correspondence provided to the Commission and she inquired whether there are any other <br /> bars in operation who allow music and that are open until midnight, especially on Sundays and <br /> Mondays. <br /> Associate Planner Eric Luchini responded that Beer Baron and McKay's Taphouse and Beer <br /> Garden, are permitted to have live entertainment and music seven days a week; although he's <br /> unsure whether McKay's Taphouse and Beer Garden are actually doing so at the present time. <br /> Planning and Permit Center Manager Melinda Denis clarified that McKay's is slightly different <br /> because their establishment is primarily outdoors, so the music is limited to an earlier hour, <br /> either 9 p.m. or 10 p.m. Beer Baron only has music indoors, and only until midnight on certain <br /> days of the week. Sidetrack Bar & Grill is also permitted to have live music until late hours, a <br /> limited number of days within the year. <br /> In response to a follow-up question from Commissioner Allen, Ms. Denis confirmed there are <br /> no other examples of downtown establishments who are permitted to have music and who <br /> operate until midnight, seven days a week. There may be others, e.g. Sunshine Saloon, <br /> outside the Downtown. <br /> Responding to Commissioner Brown, Mr. Luchini confirmed that the applicant is not requesting <br /> approval of outdoor dining at this time; but staff approval would be needed to add this <br /> component, versus Planning Commission modification of the CUP. <br /> Commissioner Allen asked and confirmed that staff did not have any concerns within the <br /> proposed CUP and request regarding music and late night operations, and confirmed if any <br /> Planning Commission Minutes Page 2 of 4 February 12, 2020 <br />istent with the surrounding area. <br /> Planning Commission Minutes Page 7 of 13 January 22, 2020 <br />
