Resolution No. PC-2003-21 <br />Page 6 <br />9. The developer acknowledges that the City of Pleasanton does not guarantee the <br />availability of sufficient sewer capacity to serve this development by the approval <br />of this case, and that the developer agrees and acknowledges that building permit <br />approval may be withheld if sewer capacity is found by the City not to be available. <br />10. This approval does not guarantee the availability of sufficient water to serve the <br />project. The City shall withhold building permits for the project if at the time <br />building permits are applied for, mandatory water rationing is in effect, unless the <br />City has adopted a water offset program and unless the developer is participating in <br />the program. Notwithstanding the developer's participation in such a program, the <br />City may withhold building permits if the City determines that sufficient water is <br />not available at the time of application of building permits. <br />11. In order to effectuate the subdivision of the property, the applicant shall submit an <br />application for a subdivision map for approval by the City. <br />12. Development on Lots 1 to 4 shall be subject to the development standards of the R- <br />1-20,000 zoning district as modified by the approved design guidelines. <br />Development on Lot 5 shall be subject to the development standards of the R-1- <br />40,000 zoning district except as modified by the approved design guidelines. <br />13. The homes on lots 3, 4, and 5 shall be limited to single story homes with a <br />maximum height of 22 ft. as measured from the lowest grade to the highest peak. A <br />deed disclosure and a sepazately recorded restrictive covenant subject to review and <br />approval by the City Attorney shall be recorded identifying the height restriction for <br />these lots. <br />14. The applicants shall obtain applicable City permits for the project prior to the <br />commencement of construction. <br />15. The applicant shall provide all buyers with copies of the project conditions of <br />approval and design guidelines. Reference to the conditions and design guidelines <br />shall be made in a deed disclosure and a sepazately recorded restrictive covenant, <br />subject to the review and approval of the City Attorney. <br />16. Design review applications for the custom homes on each of the lots shall be <br />submitted to the Planning Director for review and approval prior to submittal of <br />plans for a building permit. <br />17. All site improvements and construction activities shall be limited to the hours of <br />8:00 a.m. to 5:00 p.m., Monday through Friday, excluding Federal holidays. <br />Interior improvements may be constructed during other hours if approved by the <br />Planning Director. All construction equipment must meet DMV noise standards <br />and shall be equipped with muffling devices. <br />
