Commissioner Sedlak questioned if there was data history or just current data. He also
commented on information he has been able to obtain. Ms. Seto provided information on data
used by the City of Pleasanton.
Commissioner Clare asked about steps being taken at the State level and Ms. Seto indicated
that nothing has yet been determined which is why individual cities are moving forward on their
own.
Commissioner Carlucci wondered how people were being distinguished as e-cigarette users
vs. regular cigarette users. He also felt that the Youth Commission members should have first
met with retailers before making their recommendations. Ms. Seto advised that staff is taking
comments from other commissions that will also be presented to City Council with the
recommendations from the Youth Commission.
Commissioner Rubino Brumm stated she too would like to learn more about the bans already
in place in other communities and whether they are successful, also whether kids banned from
flavored products are turning to other tobacco products.
Chairperson Parikh opening the meeting for public comment at 7:35 pm.
Rick Kutler, Cigar Parlor— indicated the Cigar Parlor has been in operation in the City of
Pleasanton for 27 years and doesn't allow people under 21 to enter or serve e-cigarettes. He
commented on the products he sells and the pipe tobacco smokers that visit his shop and
asked that the City look at this ban prudently and carefully and consider grandfathering in his
business and others that sell premium products so they can remain in business.
Weldon Theobald — provided information about his business and felt indignant about the
proposal because his business does not serve to those under age 21 . He commented on being
a viable business with tobacco product sales being a viable source of their income and the
recommendations would mean losing approximately 40% of the business.
Mike Roesbery— owns the 7-11 at the Valero Station and their projected sales includes the
sale of cigarettes. He felt the ordinances would cause great hardship, are unfair, and
businesses should be grandfathered into the change. Mr. Roesbery felt that Juul and vaping
had brought this to the big issue it has become, believes more data is needed, and the school
distance recommendation should be reviewed. He indicated he was willing to compromise and
"go dark" and is willing to work with the community but felt some of the recommendations were
unfair.
Kristie Wang — provided details about the recent Livermore Ordinance and the successful
referendum they fought with Juul and encouraged the City of Pleasanton to follow what has
been done in Livermore. She commented on information available showing that over 5-million
kids are vaping and the numbers are growing and provided a quote from the Washington Post
on usage and products. Ms. Wang asked that children in the Tri-Valley be given the chance to
grow up tobacco-free in the Tri-Valley.
Human Services Commission
December 4, 2019
Page 3
