MATTERS BEFORE THE COMMISSION <br /> 4. Discuss Youth Commission referral to consider recommending that the City <br /> Council adopt ordinances to: (1) prohibit sale of flavored tobacco products; (2) <br /> prohibit sale of e-cigarettes and paraphernalia; (3) restrict sale of tobacco <br /> products within 1,000 feet of public schools, public parks and public recreational <br /> facilities; (4) set minimum pack sizes for some cigars and cigarettes; and (5) <br /> prohibit possession of tobacco products by persons under 21 years of age <br /> Ms. Seto commented on the Youth Commission's concern with the high use of flavored <br /> tobacco products and e-cigarettes by underage users and the decision made at their <br /> November 13, 2019 meeting recommending City Council adopt the following five (5) <br /> ordinances: <br /> 1. Prohibit the sale of flavored tobacco products city-wide; <br /> 2. Prohibit the sale of e-cigarettes and related paraphernalia city-wide; <br /> 3. Restrict the sale of tobacco products within 1,000 feet of public schools, public parks, <br /> and public recreation facilities (with pre-existing tobacco shops being allowed to remain <br /> as legal non-conforming uses); <br /> 4. Set minimum pack sizes and minimum prices for some cigars and cigarettes (with <br /> exceptions for premium items, and items sold at tobacco shops where persons under <br /> the age of 18 are restricted from entering); <br /> 5. Update the Municipal Code to prohibit persons under the age of 21 from possession of <br /> tobacco products (the code currently only restricts possession by persons under the age <br /> of 18). <br /> Youth Commission member Tejas Prakash discussed the five ordinances being recommended <br /> by the Youth Commission, research performed by the Public Policy Subcommittee and the <br /> number of retailers and licensed tobacco stores in Pleasanton and their proximity to schools, <br /> parks and recreation facilities. <br /> Ms. Seto reviewed with the commission a PowerPoint presentation outlining details pertaining <br /> to research conducted and recommendations made by the Youth Commission, California <br /> communities restricting the sale of flavored tobacco products, meetings held with tobacco <br /> retails and Economic Vitality Committee (EVC), and issues raised by retailers and <br /> recommendations from EVC. <br /> Commissioner Clare questioned why the recommendation in Ordinance #3 was only for public <br /> schools and did not include the private ones. Ms. Seto commented on the fact that private <br /> schools often move from location to location. <br /> Chairperson Parikh asked about the sensitivity of tobacco bans in other communities and <br /> available data showing effectiveness of bans in these areas. She also asked about legal <br /> challenges.
