Trustee Jamie Yee motioned to have e-cigarettes and vaping products sold only in "tobacco <br /> stores"; Will Doerlich and Shareef Mandavi second the motion after which additional <br /> discussion was requested. Trustee Jamie Yee expounded that as a "tobacco store" has a 21- <br /> age requirement to enter, business owners would need to be knowledgeable about restrictions, <br /> and fines would in place for not following the ordinance, but eliminating e-cigarettes and vaping <br /> completely would prompt those products to be obtained illegally. Councilmember Julie Testa <br /> commented that out of the four stores that were found non-compliant for selling to underage <br /> persons, two of them were 'tobacco stores' with a minimum age of 21 to enter. The motion did <br /> not pass by vote of 7-7-1 with Councilmember Julie Testa abstaining. <br /> *Olivia Sanwong was not present for this vote nor any of the remaining votes. <br /> Will Doerlich moved to amend the motion to grandfather in existing tobacco retailers, and the <br /> only new businesses permitted to sell e-cigarettes and vaping products would have to be <br /> tobacco stores; Ellen Pensky McGraw seconded the amendment to the motion. The amended <br /> motion did not pass on vote of 7-7-1 with Councilmember Julie Testa abstaining. <br /> Shareef Mandavi made a motion to ban all e-cigarettes sales in Pleasanton; Sylvia Tian <br /> seconded the motion. The motion did not pass by vote of 4-9-2 with Councilmember Julie <br /> Testa and Harsh Gohil abstaining. <br /> Will Doerlich made a motion as follows: <br /> # 1 Flavored tobacco <br /> • Exempt sales in "tobacco stores" [where entry limited to persons age 21 or older; and <br /> more than 60% of sales are from tobacco or related products] <br /> • Allow sales by tobacco retailers [e.g., grocery stores, drug stores, gas stations, <br /> convenience stores], but flavored products not visible to customers ("go dark") <br /> The motion was seconded by Steve Van Dorn and passed with a vote of 13-1-1 with <br /> Councilmember Julie Testa abstaining. <br /> Will Doerlich made a motion as follows: <br /> # 3 Restricting Sale of Tobacco Products Near Schools, Parks and Recreation Facilities <br /> • Support Youth Commission's recommendation for 1,000 foot buffer from just public <br /> schools (exempting tobacco stores) <br /> Exempt existing retailers / "grandfather" <br /> Just 1 ,000 foot buffer from public schools for new retailers <br /> The motion was seconded by Shareef Mandavi and passed by vote of 14-0-1 with <br /> Councilmember Julie Testa abstaining. <br /> Will Doerlich made a motion as follows: <br /> # 4 Minimum Pack Sizes and Pricing for Tobacco Products <br /> • No restrictions on sales <br /> The motion was seconded by Christina Nystrom Mantha and passed by vote of 10-4-1 with <br /> Councilmember Julie Testa abstaining. <br /> Sylvia Tian made a motion as follows: <br /> # 5 Possession by People Under 21 <br /> • Support Youth Commission's recommendation to prohibit possession by people under 21 <br /> The motion was seconded by Steve Van Dorn and passed by vote of 13-0-2 with Julie Testa <br /> and Harsh Gohil abstaining. <br />
