• Proposed to exempt wholesalers and distributors <br /> • Proposed to exempt FDA-approved items for medical purposes <br /> • Proposed to go into effect July 1 , 2020 <br /> Retailer concerns regarding ban on e-cigarettes, other devices and paraphernalia: <br /> • Vaping gets people to stop smoking cigarettes <br /> • Adults enjoy vaping <br /> • 55% of sales are from e-cigarettes at tobacco stores, so this ban would significantly <br /> impact business/profits <br /> • Retailers compromise/recommendation: ban e-cigarettes, not flavored tobacco, no 1,000- <br /> foot buffer and no minimum pack sizes and prices. <br /> 3: Restrict the sale of tobacco products within 1 ,000 feet of public schools, public parks, and <br /> public recreation facilities <br /> • Several cities in California have distance restrictions, including <br /> o Livermore - 1 ,000 foot buffer from public and private schools, parks, libraries and <br /> other "youth-populated-area" <br /> o Dublin - 1 ,000 foot buffer from public and private schools; 500 foot buffer from <br /> parks, libraries, playgrounds and youth centers <br /> • If sales restricted within 1 ,000 feet of just public schools, affects 4-6 of the roughly 40 <br /> tobacco retailers <br /> o Proposed to exempt "tobacco stores" to allow them to stay in business as they <br /> already restrict entry to persons to age 18 or older, and would become legal non- <br /> conforming use (no expansion, no re-location) <br /> • If sales restricted within 1,000 feet of just public parks and public recreation facilities, <br /> effects 18-22 of the 40 tobacco retailers <br /> o Proposed to go into effect July 1, 2020 (for tobacco retailers which are not"tobacco <br /> stores") <br /> o Proposed to exempt wholesalers and distributors <br /> Retailer concerns regarding 1 ,000 foot buffer: <br /> • If gas stations cannot sell cigarettes to adults, they will lose business when adults go <br /> elsewhere to buy gas, food, etc. <br /> • Retailers compromise/recommendation: restriction to be 500 feet from just public schools, <br /> or restriction to be 1 ,000 feet from just public schools. <br /> 4: Minimum Pack Sizing and Pricing <br /> • Minimum pack sizes should be 6 cigars, 25 cigarillos, and 20 little cigars, with <br /> exemption of$10+ premium cigars, hand-rolled cigars and cigars sold at stores with <br /> 21+ years entry requirement; minimum pricing should be set as well <br /> o City of Alameda requires minimum pack sizes and pricing of <br /> • Cigars minimum pack of 5 and minimum price $5 <br /> • Cigarettes minimum $7 per package (per state law 20 per package) <br /> • Little cigars minimum package of 5 and minimum $5 per package <br /> • Staff needs to further research minimum pricing <br /> • Proposed to exempt wholesalers and distributors <br /> • Proposed to go into effect July 1 , 2020 <br />
