Retailer concerns regarding minimum pack sizes and minimum prices: <br /> • Proposal for pack sizes does not reflect actual manufacturer pack sizes <br /> • Need clarity about exemption for $10 cigars and hand-rolled cigars — for example, would <br /> $7 hand-rolled cigars be allowed? <br /> 5: Prohibit persons under the aqe of 21 from possession of tobacco products <br /> • Update the existing Municipal Code <br /> • Applies to public property and private property open to the public <br /> • Allows police officer to confiscate item <br /> Retailer concerns regarding prohibiting persons under the age of 21 from possession of tobacco <br /> products: <br /> • All were in support of this proposal as retailers do not sell to people under 21 <br /> • Recommended if an underage person is caught in possession a second time, they should <br /> be sent to a class about addiction. <br /> EVC comments and questions included: <br /> • Among the cities that plan to or have banned flavored tobacco, what has the community <br /> reaction been? Are there issues with the legality of the ban? <br /> o Not about the legality of the ban but about the conditions/constraints <br /> • Have online sales been considered as part of ban? <br /> o San Francisco prohibits delivery of e-cigarette and tobacco products <br /> • Vaping was originally marketed as a healthier alternative to traditional cigarettes and <br /> has/had a better perception. Vaping is not FDA approved, and we are now coming to <br /> find out negative health risks associated that were not previously known. <br /> • Pleasanton Police conducted an undercover investigation and visited 29 tobacco sites <br /> in Pleasanton, of which 24 were in compliance and 4 were not. Businesses in the <br /> investigation were not identified; a request has been made to do so. <br /> o Livermore had a similar investigation and its percentage of non-compliant <br /> locations was higher. Livermore is local and easily accessible for Pleasanton <br /> youth to go there if they are not able to obtain the tobacco products in <br /> Pleasanton. <br /> • What is the current age to legally buy tobacco products? <br /> o 21 years old <br /> • There will always be a social trend students and youth are exposed to, and even the <br /> most academic and responsible student may try the trend. <br /> • Do adults vape flavored tobacco? <br /> o Yes, flavored tobacco products are purchased and consumed by adults. <br /> • What is the City's current smoking policy? <br /> o The City policy is no-smoking in public places, place of employment, at public <br /> events, residential rental properties, or within 20 feet of common areas in these <br /> residential rental properties. <br /> • If the Tri-Valley had a coordinated approach on tobacco sale restrictions, it would be <br /> more efficient to deter youth from illegally obtaining tobacco products as they wouldn't <br /> be available from a neighboring city. Is there discussion between the Tri-Valley to have <br /> a coordinated approach? <br />
