Retailer concerns regarding minimum pack sizes and minimum prices: • Proposal for pack sizes does not reflect actual manufacturer pack sizes • Need clarity about exemption for $10 cigars and hand-rolled cigars — for example, would $7 hand-rolled cigars be allowed? 5: Prohibit persons under the aqe of 21 from possession of tobacco products • Update the existing Municipal Code • Applies to public property and private property open to the public • Allows police officer to confiscate item Retailer concerns regarding prohibiting persons under the age of 21 from possession of tobacco products: • All were in support of this proposal as retailers do not sell to people under 21 • Recommended if an underage person is caught in possession a second time, they should be sent to a class about addiction. EVC comments and questions included: • Among the cities that plan to or have banned flavored tobacco, what has the community reaction been? Are there issues with the legality of the ban? o Not about the legality of the ban but about the conditions/constraints • Have online sales been considered as part of ban? o San Francisco prohibits delivery of e-cigarette and tobacco products • Vaping was originally marketed as a healthier alternative to traditional cigarettes and has/had a better perception. Vaping is not FDA approved, and we are now coming to find out negative health risks associated that were not previously known. • Pleasanton Police conducted an undercover investigation and visited 29 tobacco sites in Pleasanton, of which 24 were in compliance and 4 were not. Businesses in the investigation were not identified; a request has been made to do so. o Livermore had a similar investigation and its percentage of non-compliant locations was higher. Livermore is local and easily accessible for Pleasanton youth to go there if they are not able to obtain the tobacco products in Pleasanton. • What is the current age to legally buy tobacco products? o 21 years old • There will always be a social trend students and youth are exposed to, and even the most academic and responsible student may try the trend. • Do adults vape flavored tobacco? o Yes, flavored tobacco products are purchased and consumed by adults. • What is the City's current smoking policy? o The City policy is no-smoking in public places, place of employment, at public events, residential rental properties, or within 20 feet of common areas in these residential rental properties. • If the Tri-Valley had a coordinated approach on tobacco sale restrictions, it would be more efficient to deter youth from illegally obtaining tobacco products as they wouldn't be available from a neighboring city. Is there discussion between the Tri-Valley to have a coordinated approach?
