o Glen Sparks added there are disciplinary consequences for students who are <br /> found vaping, intended as a learning experience and/or counseling; however, <br /> peer to peer is the most effective deterrent. <br /> • Is there education and information given to students on the danger of vaping? Is that <br /> education enough? <br /> o Ms. Costanzo said there is education, however, kids don't understand the dangers <br /> and health risks until they're already addicted. <br /> o Glen Sparks added that vaping is becoming a broad societal issue. <br /> • Is there insight on how/where students are getting vaping and tobacco products? <br /> o Ms. Constanza indicated students are often getting products online or from older <br /> siblings, and sometimes from a store. <br /> Assistant City Attorney Larissa Seto provided an overview of tobacco retailers and distributors <br /> in Pleasanton, which includes 39 retailers and 3 distributors registered with California <br /> Department of Tax and Fee Administration (CDTFA). There are 3 Pleasanton business licenses <br /> for tobacco stores, which are defined by state law as primarily selling tobacco products and <br /> having greater than 60% of the gross annual revenues from tobacco products and <br /> paraphernalia, and prohibiting persons under 18 years unless with parent or guardian. These <br /> businesses generated $6,441 in sales tax during the second quarter 2019. <br /> Ms. Seto offered additional detail for each of the five Youth Commission recommendations, as <br /> well as feedback from the November 20 meeting with Pleasanton-based tobacco retailers (for <br /> which 40 letters of notice were sent and approximately 10 retailers attended): <br /> 1: Prohibit the (citywide) sale of flavored tobacco products <br /> • Applies to cigarettes, cigars, chewing tobacco, e-cigarette liquids, pipe tobacco and all <br /> different forms of tobacco <br /> • "Flavored" is when product has taste or aroma of menthol, mint, fruit, chocolate, candy, <br /> alcoholic beverage, herb, spice or other characterizing flavor <br /> • About 42 cities in California ban flavored tobacco (including Livermore, but not Dublin) <br /> 0 Palo Alto, Oakland and Santa Clara County's ban exempts stores limited to persons <br /> age 21 and older <br /> • Proposed to exempt wholesalers and distributors <br /> • Proposed to exempt FDA-approved items for medical purposes <br /> • Proposed to go into effect July 1, 2020 <br /> Retailer concerns regarding ban on flavored tobacco: <br /> • Adults enjoy flavored tobacco and would lose access <br /> • High percent of sales are from flavored tobacco; this would significantly impact their <br /> business/profits <br /> • Aromatic and flavored pipe tobacco should not be included in ban as young people don't <br /> smoke pipes. <br /> 2: Prohibit the sale of e-ciqarettes and related paraphernalia <br /> • Applies to electronic cigarette (e-cigarette), electronic cigar, electronic pipe, electronic <br /> hookah, whether or not the device delivers an inhaled dose of nicotine <br /> • "Paraphernalia"= cartridge, e-liquid, smoke juice, atomizer, battery, charger, etc. <br /> • Several cities in California ban e-cigarettes (including Livermore, but not Dublin) <br />
