Increases to Assessments
As stated previously, Staff recommends the formation of two new landscape
maintenance districts for the Windsor and the Bonde Ranch housing development
subdivisions to fund a sustainable landscape maintenance program with a dedicated
funding source for capital replacements. The process to form these two LMDs requires
a majority vote in support of the new district formations from the property owners in the
affected district. The necessary steps to increase the assessment as required by
Proposition 218, and the projected timeline for this process for the Windsor and Bonde
Ranch LMDs, includes the following:
• February 18, 2020 — City Council to approve resolutions initiating the proceedings
for the formation of the Windsor Landscape Maintenance District 2020-1 and the
Bonde Ranch Landscape Maintenance District 2020-2.
• March 2020 — Hold separate public outreach meetings with the Windsor LMD
property owners and the Bonde Ranch LMD property owners regarding the special
assessments. Notifications will be sent to each property owner with information
outlining the purpose of the meeting. The meetings are intended to:
o educate the property owners about the Landscaping and Lighting Act of 1972
and the subsequent passage of Proposition 218 and how it relates to their LMD
assessment; and
o identify the current assessment costs and what they cover; and
o listen to and understand the maintenance and expectations of property owners
within each district; and
o define the costs associated with a sustainable maintenance program and
repair/replacement costs of improvements; and
o specify why an increase in assessments is necessary for a sustainable
maintenance program; and
o outline the steps leading to a revised assessment and impact to the property
owners; including what a 'no' vote means and what a 'yes' vote means.
• March/April 2020 — City staff, in consultation with SCI, to prepare an Engineers
Report for each of the five existing LMDs
• March/April 2020 — City staff, in consultation with SCI, to prepare an Engineers
Report which defines the increased assessment rate for Windsor and Bonde Ranch
LMDs, including the breakdown of costs for maintenance and capital
repair/replacement.
• April 21 , 2020 — City Council to consider resolutions scheduling a Public Hearing to
answer questions about proposed increases to Windsor and Bonde Ranch and
receive voting ballots from property owners within each district.
• April 21 , 2020 — City Council to approve resolutions scheduling a Public Hearing to
approve the Engineer's Report for the five existing LMDs assuming NO changes to
Windsor and Bonde Ranch.
• April/May 2020 — Ballots to be sent out to property owners.
• June 16, 2020 — Public Hearing to receive comments and answer any questions
about the voting process, followed by receiving and tabulating of votes for Windsor
and Bonde Ranch
• July 7, 2020 — Public Hearing to receive public comment on all five LMDS, and
consider resolutions approving Engineer's Reports, setting the fiscal year 2020/21
Page 5 of 6
