Increases to Assessments <br /> As stated previously, Staff recommends the formation of two new landscape <br /> maintenance districts for the Windsor and the Bonde Ranch housing development <br /> subdivisions to fund a sustainable landscape maintenance program with a dedicated <br /> funding source for capital replacements. The process to form these two LMDs requires <br /> a majority vote in support of the new district formations from the property owners in the <br /> affected district. The necessary steps to increase the assessment as required by <br /> Proposition 218, and the projected timeline for this process for the Windsor and Bonde <br /> Ranch LMDs, includes the following: <br /> • February 18, 2020 — City Council to approve resolutions initiating the proceedings <br /> for the formation of the Windsor Landscape Maintenance District 2020-1 and the <br /> Bonde Ranch Landscape Maintenance District 2020-2. <br /> • March 2020 — Hold separate public outreach meetings with the Windsor LMD <br /> property owners and the Bonde Ranch LMD property owners regarding the special <br /> assessments. Notifications will be sent to each property owner with information <br /> outlining the purpose of the meeting. The meetings are intended to: <br /> o educate the property owners about the Landscaping and Lighting Act of 1972 <br /> and the subsequent passage of Proposition 218 and how it relates to their LMD <br /> assessment; and <br /> o identify the current assessment costs and what they cover; and <br /> o listen to and understand the maintenance and expectations of property owners <br /> within each district; and <br /> o define the costs associated with a sustainable maintenance program and <br /> repair/replacement costs of improvements; and <br /> o specify why an increase in assessments is necessary for a sustainable <br /> maintenance program; and <br /> o outline the steps leading to a revised assessment and impact to the property <br /> owners; including what a 'no' vote means and what a 'yes' vote means. <br /> • March/April 2020 — City staff, in consultation with SCI, to prepare an Engineers <br /> Report for each of the five existing LMDs <br /> • March/April 2020 — City staff, in consultation with SCI, to prepare an Engineers <br /> Report which defines the increased assessment rate for Windsor and Bonde Ranch <br /> LMDs, including the breakdown of costs for maintenance and capital <br /> repair/replacement. <br /> • April 21 , 2020 — City Council to consider resolutions scheduling a Public Hearing to <br /> answer questions about proposed increases to Windsor and Bonde Ranch and <br /> receive voting ballots from property owners within each district. <br /> • April 21 , 2020 — City Council to approve resolutions scheduling a Public Hearing to <br /> approve the Engineer's Report for the five existing LMDs assuming NO changes to <br /> Windsor and Bonde Ranch. <br /> • April/May 2020 — Ballots to be sent out to property owners. <br /> • June 16, 2020 — Public Hearing to receive comments and answer any questions <br /> about the voting process, followed by receiving and tabulating of votes for Windsor <br /> and Bonde Ranch <br /> • July 7, 2020 — Public Hearing to receive public comment on all five LMDS, and <br /> consider resolutions approving Engineer's Reports, setting the fiscal year 2020/21 <br /> Page 5 of 6 <br />
