2. Support the Youth Commission's recommendation, with any of the following <br /> modifications: <br /> a. Reduce proposed buffer to 500 feet around public schools, public parks and <br /> public recreation facilities, or only certain of these facilities (e.g. public schools <br /> only). <br /> b. Retain a 1,000-foot buffer, but apply to fewer facilities (e.g. around public schools <br /> only). <br /> c. Allow sales by tobacco retailers at all locations, but require that products not be <br /> displayed or visible to customers ("go dark"). <br /> d. If buffer is maintained, extend grandfathering provisions to allow existing tobacco <br /> retailers to continue to operate (as well as tobacco stores), but limit the <br /> establishment of any new tobacco retailers or tobacco stores. <br /> 3. Do not support any buffer or any other restriction on sales. <br /> Exhibit B shows the proposed 1,000-foot buffer around public schools (affects 4-6 tobacco <br /> retailers), and Exhibit C shows the 1,000-foot buffer around public parks and public recreation <br /> facilities (affects 11-18 tobacco retailers). The red dots on these exhibits show the location of <br /> tobacco retailers and tobacco stores. Approximately 14-18 tobacco retailers could remain if the <br /> Youth Commission's proposed 1 ,000-foot buffer is adopted. <br /> Exhibits D and E respectively show a 500-foot buffer around public schools (1 retailer affected; <br /> and 1 tobacco store within the area but proposed to be exempt); and public parks and <br /> recreation facilities (approximately 4-6 retailers affected). <br /> As noted, Exhibit A incorporates the proposed Municipal Code amendments, reflecting the <br /> Youth Commission's recommendation. Should the Planning Commission choose to make an <br /> alternative recommendation to that proposed by the Youth Commission, those changes would <br /> be reflected in the record of the Planning Commission's action, including any necessary <br /> changes to the resolution and code sections. <br /> GENERAL PLAN CONFORMANCE ANALYSIS <br /> Staff recommends that the Planning Commission consider the Youth Commission's proposed <br /> regulations and the various options to modify those regulations. In general, limitations on the <br /> sales of tobacco would be supported by the following provisions of the General Plan's Public <br /> Facilities and Community Programs Element regarding Human Services: <br /> • Goal 9: Promote a healthy community and a strong community support system. <br /> • Policy 21: Promote a healthy community through the provision of health and mental <br /> health facilities and services, and healthy community design. <br /> • Policy 24: Facilitate the provision of safe, accessible youth activities, facilities and <br /> services. <br /> • Program 24.1: Support the Youth Commission in its study of youth needs in Pleasanton. <br /> PUBLIC NOTICE AND COMMENT <br /> Notice was published in the newspaper as required by California law, and notice was also <br /> provided by email to about twelve (12) interested persons.
