ENVIRONMENTAL ASSESSMENT The imposition of restrictions on sales of tobacco products (whether through a 1,000-foot buffer or in a more limited manner) has no possibility of having a significant effect on the environment, since persons over 21 can continue to purchase tobacco products from retailers outside of any established buffer, as well as from tobacco stores. Therefore, it is recommended that the Planning Commission determine that the proposed Municipal Code amendments to limit tobacco sales would be exempt from the California Environmental Quality Act per Title 14 Cal. Code of Regulations §15061(b)(3). SUMMARY/CONCLUSION The Youth Commission's proposed amendments to the Municipal Code are intended to reduce underage exposure to tobacco products at retail locations near public schools, public parks and public recreation facilities frequently patronized by young people. The Planning Commission is asked to adopt a resolution recommending the Youth Commission's proposed amendments to the zoning code, with any modifications determined appropriate by the Planning Commission, to limit the sales of tobacco products around public schools, public parks and public recreation facilities, as well as find consistency with General Plan goals and policies that support community health. GENERAL PLAN CONFORMANCE ANALYSIS Staff recommends that the Planning Commission consider the Youth Commission's proposed regulations and the various options to modify those regulations. In general, limitations on the sales of tobacco would be supported by the following provisions of the General Plan's Public Facilities and Community Programs Element regarding Human Services: • Goal 9: Promote a healthy community and a strong community support system. • Policy 21: Promote a healthy community through the provision of health and mental health facilities and services, and healthy community design. • Policy 24: Facilitate the provision of safe, accessible youth activities, facilities and services. • Program 24.1: Support the Youth Commission in its study of youth needs in Pleasanton. PUBLIC NOTICE AND COMMENT Notice was published in the newspaper as required by California law, and notice was also provided by email to about twelve (12) interested persons. As described above, interested parties, including tobacco retailers, have attended and provided input at various meetings.
