Nicohne i -h Iy� addictl4e '' <br />°: an addictive chemic substance <br />COMPACT <br />ii 3p� ucruccu.: <br />uc, <br />?i2 TI <br />r r� <br />i ri <br />Like the proposed ban on the sale of flavored tobacco products, this proposed <br />prohibitionon electronic smoking devices.and electronic smoking device paraphernalia <br />would go into effect on July 1, 2020; would not apply to wholesalers or distributors; and <br />would exempt products authorized by the FDA for disease treatment. <br />Tobacco retailers are concerned that: the ban would affect adults who enjoy vaping; <br />many adult clients who vape have stopped smoking regular cigarettes; anda ban. would <br />end a tobacco store's business. <br />3. Prohibit Tobacco Sales within 1,000 feet of public schools, public parks and public <br />recreation facilities. The Youth Commission has recommended that to reduce youth <br />exposure to tobacco products and advertising, the -City should prohibit stores located <br />within 1,000 feet of public schools, public parks and public recreation facilities from <br />selling and displaying tobacco products. As a policy, schools, parks and recreation <br />facilities are -places where youth frequently visit and walk or bike to reach. Stores within <br />1,000 feet of these public places are often patronized by youth. <br />Contra Costa County prohibits tobacco retailers within _1,000 feet of schools, parks, <br />playgrounds and libraries; and within 500 feet of another tobacco retailer. Livermore and . <br />Richmond have a similar 1,000 -foot buffer. EI Cerrito has a 500 -foot buffer.3 <br />These restrictions are proposed to apply to retailers where tobacco sales .are less than <br />60% of gross annual receipts (a state law threshold. described more, below), for <br />example, grocery stores, drug stores, convenience- stores, and.gas stations. <br />For stores where tobacco sales represent more than 60% of total annual sales, those <br />are "tobacco stores" where persons under the age of 18 may not enter.. The proposed <br />restrictions would exempt these "tobacco stores" because there is not the same policy <br />concern. about exposure of youth, and applying these limits to these tobacco stores <br />would effectively end their businesses. However, these tobacco stores are proposed to <br />be treated as "legal non -conforming" 'uses, therefore cannot physically expand, and <br />cannot re -open if abandoned for more than 90 days. <br />3 This is information obtained during research for tobacco restrictions overall.
