That would give current <br />retailers the opportunity to sell existing stock.and modify business models as needed: <br />This prohibition would not apply to.wholesalers or distributors (as they do not sell or <br />market on a retail basis), nor to products authorized.for sale by the FDA as a drug or <br />device (typically for medical, or smoking cessation. purposes). <br />Tobacco- retailers are concerned that: many of their adult customers prefer flavored <br />tobacco products; the ban would put some tobacco stores out of business; and aromatic <br />pipe tobacco should be exempt because that is not appealing. to underage persons. . <br />2. Prohibit .Sale of Electronic.Cigarettes and related Paraphernalia. The Youth <br />Commission also recommended that the City Council adopt the proposed ordinance <br />(Attachment -3) to prohibit the sale of: (1) "Electronic Smoking Devices" — which includes <br />e -cigarettes, e=cigars,. e -pipes, e -hookahs, .as well: as component parts, that are used to. <br />deliver inhaled nicotine or other substances; and (2) "Electronic Smoking Device <br />Paraphernalia", such as e -liquids, tips, atomizers, e, -cigarette. batteries, chargers, and <br />related items. <br />Starting with, San Francisco in June 2019, many local communities' have prohibited the <br />sale of e -cigarettes, including: Berkeley, EI Cerrito, Fremont, Lafayette, Livermore, <br />Richmond, and San Mateo County.
