BACKGROUND <br /> There is an existing residence located at 7661 Foothill Road which was constructed in <br /> 1972, and which has been connected to the City water system since that date. It has a <br /> septic system for sanitary sewer. The owner of 7661 Foothill Road is Charlotte Himsl. <br /> In 2007, Ms. Himsl subdivided 7661 Foothill Road into two parcels: Parcel A contained <br /> the existing residence and retained the existing situs (property) address. Parcel B was a <br /> vacant lot and assigned a situs address of 280 Oak Lane (the subject property). <br /> Subsequent to the subdivision, a building permit was issued by Alameda County for the <br /> construction of a single-family residence at 280 Oak Lane for Robert Himsl (son of Ms. <br /> Charlotte Himsl) and his family. Instead of requesting a separate water connection from <br /> the City, water service to 280 Oak Lane was connected to 7661 Foothill Road without a <br /> separate water meter nor a water backflow prevention unit. The residence at 280 Oak <br /> Lane has been sharing the water meter at 7661 Foothill Road for the last 12 years. <br /> Sanitary sewer at 280 Oak Lane is connected to the Castlewood Service Area Sewer. <br /> Robert Himsl now wishes to establish an independent City water connection for his <br /> residence 280 Oak Lane, in anticipation of selling 7661 Foothill Road. <br /> DISCUSSION <br /> Typically, when owners of property located outside of the City limits request City utility <br /> services, the City grants such requests only after determining the use on the property to <br /> be serviced would be consistent with the City's General Plan, that no subdivision of the <br /> property is proposed, and that the property owners will enter into a preannexation <br /> agreement. A preannexation agreement requires that the property owners (and any <br /> future owners) agree to: <br /> a. pay water connection fees; <br /> b. pay all costs associated with making physical connections to City water <br /> services in a manner consistent with City standards in the determination of <br /> the City Engineer or designee; <br /> c. agree to (or vote in favor if) any future proposed annexation of the property to <br /> the City; <br /> d. obtain City design review approval for any future addition or alteration to the <br /> property requiring a building permit from the County; <br /> e. agree to not subdivide the property; and <br /> f. pay all City and County processing fees for LAFCo. <br /> In this case, the property owners are requesting a water connection with the City so that <br /> the existing residence at 280 Oak Lane would no longer share the city water meter with <br /> the house at 7661 Foothill Road. Staff conferred with LAFCo staff, who support the <br /> requested connection. <br /> Pleasanton Municipal Code requires each individual property to have a direct connection <br /> to a City water main if they are receiving city water services.
