THE CITY OF 5 <br /> CITY COUNCIL AGENDA REPORT <br /> pLE ASANTON . <br /> December 3, 2019 <br /> Community Development <br /> Planning Division <br /> TITLE: ADOPT A RESOLUTION APPROVING A PREANNEXATION AGREEMENT <br /> WITH ROBERT AND KELLI HIMSL FOR A WATER CONNECTION TO AN <br /> EXISTING RESIDENCE LOCATED AT 280 OAK LANE IN THE <br /> UNINCORPORATED ALAMEDA COUNTY <br /> SUMMARY <br /> Robert and Kelli Himsl, property owners of 280 Oak Lane in the Castlewood portion of <br /> unincorporated area of Alameda County, are requesting a connection to the City's water <br /> system because the existing residence is currently connected the water system at the <br /> adjoining residence located at 7661 Foothill Road. Prior to allowing properties outside <br /> the Pleasanton city limits to connect to City utilities, the City requires the property <br /> owners to enter into a preannexation agreement. If the preannexation agreement is <br /> approved, a party (the City, the County or the property owners) must apply for and <br /> receive an out-of-area service agreement from the Alameda County Local Agency <br /> Formation Commission (LAFCo). <br /> RECOMMENDATION <br /> 1. Approve the Preannexation Agreement between Robert and Kelli Himsl and the City <br /> of Pleasanton, subject to modifications approved by the City Manager and City <br /> Attorney, and authorize the City Manager to execute the agreement. <br /> 2. Authorize an application be filed with LAFCo for the extension of water service to this <br /> property. <br /> 3. Authorize connection of 280 Oak Lane (APN 946-4436-018-00) to the City water <br /> system, provided: all connection work is done to the satisfaction of the City Engineer; <br /> all costs are borne by the property owner; and the proposed extension of City water <br /> service is approved by LAFCo. <br /> FINANCIAL STATEMENT <br /> The property owners would be required to pay all costs associated with extending the <br /> water service, including City, County, and LAFCo permitting costs, and other agency <br /> fees, connection charges and meter fee. <br />
