This proposed prohibition on the sale of flavored tobacco products would go into effect <br />on July 1, 2020. This gives current retailers the opportunity to sell existing stock, and <br />modify business models, as needed. This prohibition would not apply to wholesalers or <br />distributors (as they do not sell or market on a retail basis), nor to products authorized <br />for sale by the FDA as a drug or device (typically for medical or smoking cessation <br />purposes). <br />2. Prohibit Sale of Electronic Cigarettes and related Paraphernalia. The Youth <br />Commission was also advised by ACPHD that: <br />a. 25% of teens have used electronic cigarettes (while only 5% have tried <br />combustible cigarettes) <br />b. 68.9% of high school students who purchased e -cigarettes buy them from the <br />store themselves or from someone else. <br />In addition, the National Youth Tobacco Survey reports that in 2019 about 5 million <br />young people report using e -cigarettes, nearly 1 million report vaping daily, and 1.6 <br />million vape 20 or more times a month. Due to health risks from e -cigarettes, the <br />California Department of Public Health has issued a health advisory urging everyone to <br />refrain from vaping, no matter the substance or source. <br />To prevent underage e -cigarette usage and health risks, the Youth Commission has <br />proposed an ordinance which would prohibit the sale of: (1) "Electronic Smoking <br />Devices" — which includes e -cigarettes, e -cigars, e -pipes, e -hookahs, as well as <br />component parts, that are used to deliver inhaled nicotine or other substances; and (2) <br />"Electronic Smoking Device Paraphernalia", such as e -liquids, tips, atomizers, e - <br />cigarette batteries, chargers, and related items. <br />Starting with San Francisco in June 2019, many local communities have prohibited the <br />sale of e -cigarettes, including: Berkeley, EI Cerrito, Fremont, Lafayette, Livermore, <br />Richmond, and San Mateo County.
