These tobacco retail restrictions are being referred to the Economic Vitality Committee <br />(EVC) for the EVC's consideration of effects on local businesses which sell tobacco <br />products and their adult customers, as the Youth Commission's concerns have been <br />focused on underage tobacco usage, advertising exposure and health issues. <br />Staff also invited tobacco retailers to meet on November 20th to learn about these <br />proposed restrictions. A summary of comments and questions raised by that effected <br />group will be shared at the EVC meeting. <br />DISCUSSION <br />1. Prohibit Sale of Flavored Tobacco and Flavored E-Ciaarette Liauids. The Youth <br />Commission was told by the Alameda County Public Health Department (ACPHD) that: <br />a. 87.6% of youth tobacco users in Alameda County used a flavored tobacco <br />product, with fruit and sweet the most popular; and <br />b. 81 % of youth who try tobacco choose flavored tobacco as their first product. <br />Based on this and other information about underage flavored tobacco usage, the Youth <br />Commission proposed an ordinance to prohibit the retail sale of flavored tobacco <br />products. This would apply to cigarettes, cigars, chewing tobacco, e -cigarette liquids <br />(whether or not it contains tobacco or nicotine), snuff, and pipe tobacco which have a <br />taste or aroma of menthol, mint, wintergreen, fruit, chocolate, vanilla, honey, candy, <br />cocoa, dessert, alcoholic beverage, herb, spice or other characterizing flavor. <br />As of October 2019, about 42 communities in California have restricted the sale of <br />flavored tobacco products, including locally: Alameda, Albany, Berkeley, Contra Costa <br />County, EI Cerrito, Hayward, Lafayette, Livermore, Oakland, Palo Alto, Richmond, San <br />Leandro, and San Pablo.2 Palo Alto, Oakland, Santa Clara County and other cities <br />have an exemption for stores serving only persons 21 or older. <br />Attachment 1 sets forth the proposed prohibition as a new Chapter 9.31 of the <br />Pleasanton Municipal Code, prohibiting these types of products: <br />27 <br />01 MENTMO_ <br />RI , <br />POWER <br />W rode <br />maho <br />ro=WARNING: Cigar TMa product r <br />can cause cancers contains <br />nicotine.
