EXHIBIT E
MINUTES
ZONING ADMINISTRATOR
Pleasanton, California
Council Conference Room
200 Old Bernal Ave., Pleasanton
Thursday, July 25, 2019
CALL TO ORDER
The meeting was called to order at 9:30 a.m. by Ellen Clark, Zoning Administrator.
Present: Dr. Nadia Malik, Fayyaz Malik Applicant's, Wafaa Almahamid, Michael Moone,
Vishant Gandhi, Harsha Gandhi, Niraj Gandhi, Appellants
Staff: Ellen Clark, Zoning Administrator; Jenny Soo, Associate Planner; Amy
Statham, Senior Office Assistant
P19-0130, Malik, ADU, 7218 Moss Tree Way
Application to construct an approximately 480-square-foot Accessory Dwelling Unit
above the existing garage on the east side of the existing two-story residence.
Ms. Clark welcomed the applicant and public to the July 25, 2019, Zoning Administrator hearing
and asked Ms. Soo, the project planner, to give a brief update on the project.
Ms. Soo briefly explained the project and stated that staff recommends approval subject to the
conditions of approval.
Ms. Clark asked Ms. Soo if the ADU as designed meets all of the City's zoning and set-back
requirements and Ms. Soo replied that it does.
Ms. Clark asked Ms. Soo if proposed parking was consistent with ADU requirements. Ms. Soo
replied that one driveway space is allowable for ADUs. Two parking spaces are required for the
home and the home has a two-car garage allowing ample parking.
Ms. Clark asked Ms. Soo if efforts were made by the applicant to modify the design or discuss
this project with their neighbors. Ms. Soo replied that she and the architect had an email
exchange and a sun study was discussed to address the issue of light blockage. No other
discussions have taken place.
THE PUBLIC HEARING WAS OPENED.
Ms. Clark invited the applicant to speak.
Ms. Alamhamid, the architect for the applicants, spoke about various aspects of the project
including light shadowing, window location and window sizing for the proposed ADU.
Ms. Clark invited any member of the audience to speak.
e new construction is going to block all sunlight coming into our home and the bedrooms are
going to get dark. The big wall that they propose to build is going to be less than 10 feet from
our house! We had bought the house and paid the premium price in Pheasant Ridge community
because among other reasons, we didn't want houses closely packed, this proposed
construction is going to take that away from us. That is going to drastically affect our quality of
life as well as property value.
An updated design was submitted by the applicant to address some of the privacy issues we
had raised. It seems in this design the width of the siding also encroaches a bit more into the
setbacks on the side of the house. None of the other homes in our neighborhood have had large
siding walls or overhangs like that put up and we are worried it would look out of place.
During the design review hearing process it became very clear that no matter what we said or
how it affected us, this was going to get approved. During the hearing we suggested an II
at its closest point,a larger setback than the standards would require. The proposed addition would be built directly above the
existing garage and would maintain the existing building setback.
P19-0130 Planning Commission
11 of 15
