ATTACHMENT 1 <br />ORDINANCE NO. <br />AN ORDINANCE OF THE CITY COUNCIL FOR A FOR PLANNED UNIT <br />DEVELOPMENT (PUD) DEVELOPMENT PLAN TO DEMOLISH AN EXISTING HOME <br />AND CONSTRUCT THREE NEW DETACHED SINGLE-FAMILY HOMES AND <br />RELATED IMPROVEMENTS LOCATED AT 3987 STANLEY BOULEVARD, AS FILED <br />UNDER CASE NO. PUD -133 <br />WHEREAS, on October 2, 2018 Saravana Chilla ("Applicant") applied fora PUD <br />development plan approval under Case No. PUD -133 to demolish an existing home and <br />construct three new detached single-family homes and related improvements ("Project) located <br />at 3987 Stanley Boulevard ("Property); and <br />WHEREAS, the Property is designated High Density Residential in the General Plan; <br />and <br />WHEREAS, the Property is Zoned Planned Unit Development -High Density Residential <br />(PUD -HDR) District; and <br />WHEREAS, the Property is located in the Downtown Specific Plan area with a land <br />use designation of High Density Residential; and <br />WHEREAS, after a June 12, 2019, workshop, on August 28, 2019, the Planning <br />Commission, following notification to the public in the prescribed manner, conducted a public <br />hearing and considered relevant exhibits, recommendations of the City staff concerning this <br />application, and received testimony from the applicant and interested parties, and, forwarded a <br />recommendation of approval of the project to the City Council; and <br />WHEREAS, on October 1, 2019 the City Council, following notification to the public in <br />the prescribed manner, conducted a public hearing, and considered the written agenda report, <br />public testimony, related project materials, and staff recommendations; and <br />WHEREAS, the proposed project is categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA) pursuant to 15182, Projects Pursuant to a Specific <br />Plan; and <br />WHEREAS, after review of the materials presented, the City Council determined that the <br />PUD plan is consistent with the General Plan, Downtown Specific Plan, and purposes of the <br />PUD ordinance based on the considerations set forth in this ordinance. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />HEREBY ORDAIN AS FOLLOWS: <br />SECTION 1: The City Council finds that the project is exempt from further <br />environmental analysis pursuant to Section 15182 because it is consistent with the Downtown <br />Specific Plan and General Plan, and creates no new impacts. <br />SECTION 2. With respect to the Planned Unit Development application, PUD -133, the <br />City Council makes the following findings and determinations with respect to each of the <br />considerations for approval of a PUD Development Plan as required by Section 18.68.110 of the <br />Pleasanton Municipal Code (PMC): <br />
